WHEREAS, the City of Little Rock must acquire in fee simple
absolute a 0.65 acre tract of land (Tract A) lying along Rock
Creek for the Fourche Creek Flood Reduction Project; and
WHEREAS, in lieu of cash compensation by the City for the
purchase of Tract A, the owner desires to exchange Tract A for an
adjacent parcel of land owned by the City of Little Rock (Tract
B); and
WHEREAS, the appraised value of Tract A is less than the
appraised value of Tract B and the landowner is willing to pay the
City the difference in the appraised values; and
WHEREAS, Tract B is an unimproved parcel on the banks of
Rock Creek and is no longer needed for corporate purposes because
it is not needed for flood control or access to adjacent City
property and the property to be acquired in this exchange better
serves the public purpose of flood control for this project. (See
attached parcel map)
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor and City Clerk are authorized to
exchange Tract B for Tract A provided that the landowner pay to
the City of Little Rock, in cash, the difference between the
appraised value of Tract A and Tract B.
