A RESOLUTION AUTHORIZING THE MAYOR TO APPROVE
AN OPERATIONAL AGREEMENT BETWEEN THE CITY OF
LITTLE ROCK AND PULASKI COUNTY FOR THE
OPERATION OF JAIL FACILITIES.
WHEREAS, The City of Little Rock and Pulaski County desire
to enter into a contractual agreement whereby city funds are made
available to the County to assist in the operation of a new eight
hundred bed jail facility, and
WHEREAS, The County recognizes that upon completion of the
construction of a new jail facility, the City of Little Rock
desires to close its current jail facility with detainees arrested
by the Little Rock Police Department to be held in said new jail
facility; and
WHEREAS, The City of Little Rock desires to compensate the
County for this obligation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1: The Mayor is authorized to approve an agreement
between the City of Little Rock and Pulaski County for the
operational maintenance of a new jail facility in substantially
the same form as the memorandum of agreement attached.

MEMORANDUM OF AGRE?'•:ENT
This agreement is entered into by ?ulaski County, Arkansas
(the County) and the cities of Little Rock, North Little Rock,
Jacksonville, Maumelle and Sherwood (the Cities) pursuant to the
authority of Ark. Code Ann. 5§25 -20 -101 et sea., and will become
binding on all parties upon ratificaticn by the Quorum Court of
Pulaski County and the various City Councils or Boards of
Directors of the cities.
WHEREAS, the County recognizes that 't has the responsibility
to maintain and operate detention facilities (hereinafter "jail ");
and
WHEREAS, the Cities acknowledge the shortage of operational
revenues of Pulaski County because of a decreasing County tax
base; and
WHEREAS, the County and the Cities acknowledge the need for a
strong and economically viable jail in the area; and
WHEREAS, the County has committed its maximum tax resources
available to the construction and operation of a proposed regional
jail to serve the County and the Cities; and
WHEREAS, the Cities and the County desire to enter into a
contractual agreement whereby City funds are made available to the
County to assist in the operation of a new regional jail.
IT IS THEREFORE hereby agreed that:
SECTION 1. The City of Litle Rock shall make the following
annual payments to Pulaski County to help defray operation costs
of a new jail:

SECTION 2. The City of Jacksonville shall make the following
payments to Pulaski County to help defray operation costs c_` a new

SECTION 4. The City of Maumelle shall make annual payments to
Pulaski County for the duration of this agreement equal to five
percent (5p) of its share of the County Sales and Use Tax imposed
pursuant to Act of
SECTION 5. The City of North Little Rock shall lease the
North Little Rock jail to the County for $1.00 per year, and the
County shall manage and operate the North Little Rock jail as a
part of the regional jail.
SECTION 6. The City of North Little Rock shall make the
following payments to Pulaski County to pay the bonded
indebtedness on the North Little Rock jail and to help defray the
costs of operating the new regional jail:
$375,000 /year - first five years
$425,000 /year - next five years
$475,000 /year - next five years
$525,000 /year - last five years

SECTION ?. The City of North Little Rcck shall assign to the
County the agreement with the U.S. Mashall's office to make
available up to twenty (20) beds. The County shall keep all
revenue earned. (Estimated to be approximately Two Hundred
Thousand ($200,000) annually).
SECTION 8. In consideration of the above, the Cities (other
than North Little Rock) will close their current jail facilities
and in the future operate only a limited number of short -term
lockup cells.
SECTION 9. The County shall cooperate with the Cities by
providing- -.shuttle service between city lockup facilities and the
regional jail at least every six hours. However, the Cities may
deliver prisoners directly to the regional jail if more
convenient.
SECTION 10. The payments identified above shall commence upon
completion of a new County jail facility and the closing of the
Cities' jails. Said payment shall be made monthly, on or before
the fifteenth (15th) day.
SECTION 11. The Cities agree to support aggressively a
county -wide temporary 1% Sales and Use tax for the construction of
an 800 -bed core facility with growth potential.
SECTION 12. An advisory committee consisting of municipal
police chiefs of each of the participating entities and judicial
representatives shall be appointed by the County Judge to oversee
the implementation and operation of this agreement.
SECTION 13. The duration of this agreement shall be twenty
(20) years, subject to extension by agreement of the parties.

SECTION 14. If any of the cities fail to ratify this
agreement, the County may, at its option, enter into the agreement
with respect to the remaining parties only.
SECTION 15. Non - Appropriation. Nc- withstanding anything
contained in this Agreement to the contrary, if the appropriate
city governmental body fails to appropriate funds for subsequent
periods within the term of this Agreement. that city shall not be
obligated to make payments beyond t then- current fiscal
appropriation period provided that once an appropriation is made,
the city is obligated to provide funds for that appropriation
period and the County is obligated to hcuse city prisoners for
that period. However, once a city fails tc appropriate funds, the
County is no longer required to house that city's prisoners.
