RESOLUTION NO. 8,152
A RESOLUTION AUTHORIZING THE
EXCHANGE OF QUITCLAIM DEEDS BETWEEN
THE CITY OF LITTLE ROCK, ARKANSAS,
AND CONGREGATION B'NAI ISRAEL FOR
PROPERTY IN OAKLAND CEMETERY, AND
PRESCRIBING MATTERS RELATING
THERETO.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. That the exchange of quitclaim deeds for
property located in Oakland Fraternal Cemetery between the City
of Little Rock, Arkansas and the Congregation B'Nai Israel is
hereby authorized. The Mayor and City Clerk are hereby
authorized to execute, acknowledge, and deliver the Quitclaim
Deed for and on behalf of the City. The form and content of the
Quitclaim Deed is hereby approved and made a part hereof, as
Exhibit A.
SECTION 2. That the Mayor and City Clerk, for and on
behalf of the City, are hereby authorized and directed to do all
things, execute all instruments and otherwise take all action
necessary to the realization of the rights of the City and to
discharge the obligations of the City under the terms of the
Quitclaim Deed.
SECTION 3. That the Board of Directors hereby finds and
declares that the exchange of Quitclaim Deeds is in the
furtherance of the public interest, and does not impair the
public uses of Oakland Fraternal Cemetery.

SECTION 4. That the provisions of this Resolution are
hereby declared to be separable, and if any section, phrase or
provision shall, for any reason, be declared to be invalid, such
declaration shall not affect the validity of the remainder of
the sections, phrases or provisions.
SECTION 5. That all ordinances and resolutions and parts
thereof in conflict herewith are hereby repealed to the extent
of such conflict.
SECTION 6. This resolution shall be in full force and
effect from and after its adoption.

QUITCLAIM DEED
KNOW ALL MEN BY THESE PRESENTS:
THAT the City of Little Rock, Arkansas, a municipal
corporation organized under the laws of the State of Arkansas,
GRANTOR, for and in consideration of the sum of one Dollar
($1.00) and other good and valuable consideration, paid by
Congregation B'nai Israel, Inc., GRANTEE, the receipt of which
is hereby acknowledged, does hereby grant, convey, and quitclaim
unto the said Grantee and unto its heirs and assigns forever,
all of its right, title, interest, equity and estate in and to
the following described lands in Oakland Fraternal Cemetery
situated in the County of Pulaski, State of Arkansas:
Part of the Southeast 1/4, Section 11, T -1 -N,
R -12 -W, Pulaski County, Arkansas, more
particularly described as follows:
Commencing at the Northeast corner of Block 33,
Masonic Addition to the City of Little Rock,
Arkansas; thence South 01° 56' 45" West 99.09
feet to the POINT OF BEGINNING; thence South 88'
25' 04" East 114.91 feet; thence South 01' 29'
24" East 466.62 feet; thence North 89' O1' 39"
West 466.62 feet; thence North 00' 43' 21" West
469.57 feet; thence South 88' 42' 15" East 345.56
feet to the POINT OF BEGINNING containing 4.980
acres more or less.
and:
Commencing at the Northeast corner of Block 33,
Masonic Addition to the City of Little Rock,
Arkansas, thense South 01° 56' 45" west 99.09
feet; thence North 88° 42' 15" West 345.56 feet
to the POINT OF BEGINNING; thence South 00° 43'
21" East 469.57 feet; thence North 89° 01' 39"
West 344.44 feet to a point lying on the East
right -of -way line of Barber Street (60' R -W);
thence North 00' 21' 45" East along said East
right -of -way 468.91 feet; thence South 89° 06'
31" East 335.54 feet to the POINT OF BEGINNING,
containing 3.662 acres more or less.
To have and to hold the same unto the said Grantee and
unto its heirs and assigns forever, along with all tenements,
appurtenances and hereditaments thereunto belonging.

THAT Congregation B'Nai Israel, a non - profit corporation
organized under the laws of the State of Arkansas, GRANTOR, for
and in consideration of the sum of one Dollar ($1.00) and other
good and valuable consideration, paid by the City of Little
Rock, Arkansas, GRANTEE, the receipt of which is hereby
acknowledged, does hereby grant, convey, and quitclaim unto the
said Grantee and unto its heirs and assigns forever, all of its
right, title, interest, equity and estate in and to the
following described lands in Oakland Fraternal Cemetery situated
in the County of Pulaski, state of Arkansas:
Five acres in the SE 1/4 of Section 11, Township
1 North, Range 12 West, described more
specifically as follows:
All that land lying West of and adjacent to
Oakland Cemetery, as the same is laid out and
fenced off and bounded by a line commencing at a
point on the quarter section line between the
Northeast and Southeast quarters of said section,
1,400 feet East of the center of said section,
thence running South 7 chains and 7 links, then
East 7 chains and 7 links, thence North along the
West boundary line of Oakland Cemetery 7 chains
and 7 links to quarter section line between the
Northeast and southeast quarters of said section,
thence West on said line 7 chains and 7 links to
place of beginning.
To have and to hold the same unto the said Grantee and
unto its heirs and assigns forever, along with all tenements,
appurtenances and hereditaments thereunto belonging.
IN WITNESS WHEREOF, the Congregation B'Nai Israel has
caused these presents to be signed by its President, and
