RESOLUTION NO. 81122
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE THE NECESSARY DOCUMENTS TO GRANT AN
EASEMENT FOR DRAINAGE AND STORMWATER DETENTION
PURPOSES ON LANDS OWNED BY THE CITY FOR USE OF
THE PORT AUTHORITY; AND AUTHORIZING THE TRANSFER
OF TITLE TO THE LANDS TO PICRON PROPERTY OWNERS,
ADJACENT TO THE PORT AUTHORITY INDUSTRIAL PARK.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor and City Clerk are hereby
authorized to execute the necessary documents to grant an
easement for drainage and stormwater detention purposes on lands
owned by the City for use by the Port Authority.
SECTION 2. The Mayor and City Clerk are further
authorized to execute the necessary documents for the transfer
of lands adjacent to the Port Authority Industrial Park to
Picron Property Owners.

DEDICATION OF EASEMENT

KNOW ALL PERSONS BY THESE PRESENTS:
THAT WHEREAS, THE CITY OF LITTLE ROCK, ARKANSAS, a
municipal corporation duly organized pursuant to the laws of
the State of Arkansas (the "City ") , owns the property
described on the attached Exhibit "A" (the "Property "); and
WHEREAS, said Property is needed for a drainage and
stormwater detention easement; and
WHEREAS, the City is desirous of dedicating same for
drainage and stormwater detention purposes for its benefit and
the benefit of the public generally.
NOW, THEREFORE, in consideration of the benefits to
it and the public generally, the City pursuant to Resolution
No. adopted , 1989, by the Little
Rock, Arkansas City Board of Directors, hereby dedicates to
the public a perpetual and assignable drainage and stormwater
detention easement and right of way for passage and storage of
stormwater in, on, of or across the Property. This easement
shall also include the right of the City to enter on and
maintain the above - described lands and remove therefrom all
trees, underbrush, obstructions and any other vegetation,
structures or obstacles within the Property, which right shall
survive any conveyance of the fee interest in the Property by
the City. Likewise, the City and its successors and assigns,
covenant that it shall not alter the ground contours of the
Property. Henceforth, in any conveyance or subdivision of the
Property, the owners and grantees shall take subject to the
easement hereby created and dedicated, reserving, however, to
the City and its successors and assigns, all such rights and
privileges as may be used without interfering with or
abridging the rights and easement hereby acquired, including
but not limited to granting to public utilities the right to
use the Property for easement purposes.
TO HAVE AND TO HOLD said easements, rights and
privileges unto the public generally, forever, for the
purposes aforesaid.
IN WITNESS WHEREOF, the name of the CITY OF LITTLE
ROCK, ARKANSAS is hereby hereunto affixed by its Mayor and
City Clerk and its seal affixed by its City Clerk this _ day

consideration of the sum of Ten Dollars ($10.00) and other
good and valuable consideration, paid by Southland Building
Products Company, Fixed Assets Leasing Co., T. Ray Cannon,
Successor Trustee, Edwin B. Cromwell, Trustee, Edwin B.
Cromwell, Individually and as agent for Henrietta L. Cromwell,
his wife, Jean Purrington Remmel, Curtis H. Stout, J. T. Laman
and Hazel Laman, his wife, and First Commercial Bank, N.A.,
Trustee of the Raymond Remmel Trust, the Mary Remmel Trust,
the Jared Jennings Lowry Trust, the Joshua Neal Lowry Trust
