The City Manager is hereby authorized to enter into the attached mutual aid agreement with the City of Shannon Hills, Arkansas, for the provision of coordinated 9 -1 -1 emergency number answering services. ADOPTED: August 2, 1988 ATTEST: APPROVED: CI Y CLERK JAdE CZECH YO LOTTIE SHACK FORD APPROVE AS T FORM: MARK STODOLA, CITY ATTORNEY P-- � 0 A..3 293 9 -1 -1 PUBLIC SAFETY COMMUNICATIONS MUTUAL AID AGREEMENT BETWEEN THE CITY OF SHANNON HILLS, ARKANSAS AND THE CITY OF LITTLE ROCK, ARKANSAS This agreement is made and entered into the 3rd day of August 1988, by and between the City of Shannon Hills, ( "Shannon Hills "), a City of the second class, and the City of Little Rock ( "Little Rock "), a City of the first class, WITNESSETH: WHEREAS, Act 683 of 1985, the Arkansas Public Safety Communications Act, codified as Ark. Code Ann. § 12 -10 -301 et. seq. (1987), authorizes mutual aid agreements between political subdivisions to provide a coordinated 9 -1 -1 emergency number answering service system; and WHEREAS, the City Council of Shannon Hills has, by Resolution No. , authorized Shannon Hills to enter into a mutual aid agreement with the City of Little Rock for the purpose of providing such coordinated 9 -1 -1 emergency number answering service system; and M M M M V A = = M M M M M M 294 WHEREAS, the Board of Directors of the City of Little Rock, by Resolution No.7,995, has authorized the City to enter into a mutual aid agreement with Shannon Hills to coordinate the 9 -1 -1 emergency number answering service system, NOW, THEREFORE, in consideration of the mutual covenants of the parties, Little Rock's 9 -1 -1 public safety communications center is designated to serve as both a public safety answering point and dispatch point for Shannon Hills Public Safety Agencies pursuant to Ark. Code Ann. § 12 -10 -305 (1987) as follows: ARTICLE 1 Term: The duration of this agreement shall be year -to -year with renewal of the agreement occurring automatically on December 31 regardless of the date the agreement is first entered. The agreement may be terminated by either party upon sixty (60) days notice. ARTICLE 2 Performance of the Parties: Central Communications Center, a multipurpose communications facility of the City of Little Rock Office of Emergency Services, shall answer the local 9 -1 -1 emergency number and process it in accordance with policies and procedures agreed upon by both the City and Shannon Hills. ■� iw w w w�w w w ■■ � w w w w w 295 ARTICLE 3 Consideration: In exchange for receiving the benefits of a central answering point and dispatch point, Shannon Hills shall direct that all monies credited to it from the service charge tax on telephone basic rates for 9 -1 -1 shall be credited to the City of Little Rock's 9 -1 -1 account via Metroplan. Furthermore, Shannon Hills agrees to maintain the same rate of service charge as the City of Little Rock. ARTICLE 4 Indemnity: In consideration of the provision of 9 -1 -1 answer and dispatch services by the City of Little Rock to the Shannon Hills Police Department, the City of Shannon Hills shall indemnify, keep and save harmless the City of Little Rock, its agents, officials, and employees, against all injuries, deaths, loss, damages, claims, suits, liabilities, judgments, costs and expenses, which may in any wise accrue against the City of Little Rock in consequence of the entry into this mutual aid agreement or which may in any wise result therefrom, whether or not it shall be alleged or determined that the act was caused through negligence or omission of the City of Little Rock or its employees, and the City of Shannon Hills shall, at its own expense, appear, defend, and pay all charges of attorneys, and 296 all costs and other expenses arising therefrom or incurred in connection therewith, and, if any judgment shall be rendered against the City of Little Rock in any such action, the City of Shannon Hills shall, at its own expense, satisfy and discharge the same. The City of Shannon Hills expressly understands and agrees that any performance bond or insurance protection provided by it shall in no way limit the responsibility to indemnify, keep, and save harmless and defend the City of Little Rock, as herein provided.
