4 A RESOLUTION AMENDING RESOLUTION NO. 7,807
5 AUTHORIZING THE CITY MANAGER TO NEGOTIATE
6 CONTRACTS FOR THE PURCHASE OF PROPERTY IN FEE
7 SIMPLE, ALONG THE FOURCHE CREEK DRAINAGE PROJECT
8 FOR THE GREEN FINGER PARKS PLAN; AUTHORIZING
9 THE MAYOR AND CITY CLERK TO EXECUTE THE NECESSARY
10 DOCUMENTS FOR THE PURCHASE OF PROPERTY IN FEE;
11 AND, FURTHER AUTHORIZING THE CITY ATTORNEY TO
12 PROCEED WITH CONDEMNATION PROCEDURES FOR ANY
13 PARCEL WHICH THE CITY IS UNABLE TO PURCHASE.

15 WHEREAS, the City has appropriated funds for the
16 acquisition of land along the banks of Fourche Creek for flood
17 control; and
18 WHEREAS, the City desires to also use such property to
19 develop the land adjacent to Fourche Creek in conformance with
20 its Green Finger Parks concept pursuant to the Park System
21 Master Plan of 1983, as amended; and
22 WHEREAS, Ark. Code. Ann § 18 -15 -301 provides the City of
23 Little Rock with the power to condemn property for parks.
24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
25 OF THE CITY OF LITTLE ROCK, ARKANSAS:
26 SECTION 1. Resolution No. 7,807 is hereby amended to
27 authorize the City Manager to negotiate contracts for the
28 purchase of property in fee simple for the Fourche Creek
29 Drainage Project and Green Finger Parks concept, pursuant to the
30 Park System Master Plan of 1983, as amended.
31 SECTION 2. The Mayor and City Clerk are hereby
32 authorized to execute all documents necessary for the purchase
33 of the property in fee, easements and rights -of -way for this
34 Project.

SECTION 3. The City Attorney is hereby authorized to
proceed with condemnation procedures for any parcel of property
which the City is unable to purchase.
