HomeMy WebLinkAbout6889RESOLUTION NO. 6,889 J 190 RESOLUTION OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK APPROVING AND AUTHORIZING THE EXECUTION OF A WARRANTY DEED CONVEYING A CERTAIN TRACT OF LAND SITUATED IN THE LITTLE ROCK PORT INDUSTIRAL PARK TOGETHER WITH AN ASSIGNMENT OF EASEMENTS IN FAVOR OF THE CITY OF LITTLE ROCK FOR THE USE AND BENEFIT OF THE SANITARY SEWER COMMITTEE FOR THE PURPOSE OF UTILIZING SAID TRACT OF LAND IN CONNECTION WITH THE EXISTING PUMP STATION AND APPURTENANCES THERETO WHEREAS, it is in the best interest of the City of Little Rock that a certain tract of land containing 0.35 acres more or less together with all improvements thereon be conveyed to the City of Little Rock for the use and benefit of the Sanitary Sewer Committee for the purpose of being operated and maintained by the Sewer Committee in connection with the existing pump station and that said conveyance be approved and authority be granted for the Mayor of the City of Little Rock to execute a Warranty Deed together with an assignment of easements set forth on Appendix "A" hereto in favor of the City of Little Rock for the use and benefit of the Sanitary Sewer Committee, said tract being more particularly described as follows: A parcel of land situated in the NW 1/4 NE 1/4 and also in the NE 1/4 NW 1/4, in Section 21, Township 1 North, Range 11 West of the Fifth Principal Meridan, City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: Commencing at the Northeast Corner of Section 21, Township 1 North, Range 11 West of the Fifth Principal Meridan; thence along the North line of said Section 21, N 88 °47'31" W, 1312.43 feet to the NW Corner of the NE 1/4 NE 1/4 of said Section 21; thence continuing along said North line of Section 21, N 88 °47'31" W, 1215.41 feet; thence S O1 °12'29" W, 60.00 feet to a point which is the intersection of the South right -of -way line of Frazier Pike and the West line of a utility easement, said point also being the Point of Beginning; thence along said West easement line, S 17 139'29" W, 155.63 feet; thence N 88 °47'31" W, 79.47 feet; thence N O1 012129" E, 149.25 feet to a point on the South right -of -way line of Frazier Pike; thence along said South right - of -way line, S 88 147131" E, 123.54 feet to the Point of Beginning, and containing 0.35 acres, more or less. 191 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The proposed conveyance of the tract of land together with all improvements thereon and assignment of easements described herein is hereby approved and authority is hereby granted to the Mayor of the City of Little Rock to execute a Warranty Deed in favor of the City of Little Rock for the use and benefit of the Little Rock Sanitary Sewer Committee upon the terms and conditions contained therein and to do all other acts necessary and incidental in connection therewith. ADOPTED: November 16, 1982 APPROVED: MAYOR ATTEST: awl, 4cek City C.Uerx -2- 192 AGREEMENT This Agreement made on September 30th 1982 by and between the Little Rock Port Authority ( "Port Authority ") and the Sanitary Sewer Committee of Little Rock, Arkansas ( "Sewer Committee ") ; WHEREAS certain real property and improvements are owed by the City of Little Rock and situated on lands occupied by the Little Rock Port Authority consisting of a sewage pump station located in a one story brick structure together with pumps, switch gear and operating appurtenances, site fencing and driveways and approximately 16,747 lineal feet of 12" cast iron sewage forcemain extending from the pump station to the influent junction structure on the Adams Field Wastewater Treatment Plant grounds( "pump station and sewage main "); and the Port Authority has heretofore assumed all financial and maintenance responsibilities for the operation of the pump station pursuant to an agreement dated February 17, 1971; and, WHEREAS, the Port Authority desires that all of its right, title, ownership or maintenance responsibilities to the pump station and sewage main be conveyed or assigned in favor of the Sewer Committee so that the Sewer Committee will have all right, title, ownership and financial and maintenance responsibilities for the operation of the pump station and the Sewer Committee is agreeable to such conveyance or assignment in consideration of the benefits accruing to it including but not limited to the acquisition of the easement rights for the 12" sewage forcemain; NOW, THEREFORE, in consideration of the mutual benefits to be derived it is hereby agreed by and between the parties: 1. Assignment by Port Authority to the Sewer Committee of all right, title, ownership and maintenance responsibilities in Certain Sewer facilities and Easements related thereto. The Port Authority hereby assigns all of its right, title, ownership 193 or maintenance responsibilities to a certain sewage pump station hereinafter described and all easements related thereto as more specifically set forth on Appendix "A" attached hereto, said pump station being located in a one story brick structure together with pumps, switch gear and operating appurtenances, site fencing and driveways and approximately 16,747 lineal feet of 12" cast iron sewage forcemain extending from the pump station to the influent junction structure on the Adams Field Wastewater Treatment Plant grounds. This pump station is located on a tract of land situated in Pulaski County, Arkansas identified as Little Rock Port Sanitary Sewer Pump Station, located in Area 102 as shown on a certain plat identified as Little Rock Port Industrial Park filed for record in the office of the Circuit Clerk, Pulaski County, Arkansas on December 16, 1971, in Plat Book 27, page 86, and referred to in the Bill of Assurance set forth in Deed Record Book 1145, page 543, also filed in the office of the Circuit C1erk,Pulaski County, Arkansas, situated more particularly described as follows: Commencing at the Northeast Corner of Section 21, Township 1 North, Range 11 West of the Fifth Principal meridian; thence along the North line of said Section 21, N 88 047131" W, 1312.43 feet to the NW Corner of the NE 1/4 NE 1/4 of said Section 21; thence continuing along said North line of Section 21, N 88 °47131" W, 1215.41 feet; thence S 01 °12'29" W, 60.00 feet to a point which is the intersection of the South right -of -way line of Frazier Pike and the West line of a utility easement, said point also being the Point of Beginning; thence along said West easement, said point also being the Point of Beginning; thence along said West easement line, S 17 139129" W, 155.63 feet; thence N 88 °47'31" W, 79.47 feet; thence N 01 012'29" E, 149.25 feet to a point on the South right -of -way line of Frazier Pike; thence along said South right -of -way line, S 88 °47131" E, 123.54 feet to the Point of Beginning, and contain- ing 0.35 acres, more or less. 2. Conveyance of Pump Station land for the use and benefit of the Sewer Committee. The Port Authority further agrees to take all actions necessary and execute all documents necessary for the conveyance of the land on which the pump station is situated together with all the improvements related thereto to be made as soon as possible by the City of Little Rock for the use and benefit of the Sewer Committee. -2- 194 3. Acceptance of Assignment by Sewer Committee and Agreement to operate and maintain Sewer Facilities. The Sewer Committee hereby accepts the assignment of all right, title and ownership of the sewer facilities set forth in paragraph No. 1 and further covenants to operate and maintain said facilities. Isgrig, Sr. unto the City of Little Rock, Arkansas, for the use and benefit of the Little Rock Port Authority, as recorded in Deed Book 1097, page 179, in the office of the Circuit Clerk of Pulaski County, Arkansas, on January 28, 1970; and all other easements across any part of Lots 9, 10, 11 and 12 of L. P. Coleman Subdivision, an addition to the City of Little Rock; Lot 1, Block 1, Richland Subdivision; Lots 7 and 8, Cherry Hill Subdivision, an addition to the City of Little Rock; and across any other contiguous lands situated in either Sections 8 or 9 T -1 -N, R -11 -W, Pulaski County, Arkansas. WARRANTY DEED (Corporation) KNOW ALL MEN BY THESE PRESENTS: That the City of Little Rock, Arkansas, by its Mayor, duly 196 authorized by the Board of Directors of the City of Little Rock, Arkansas pursuant to Resolution No. 6,889 , dated November 16 , 1982, GRANTOR, for the consideration of the sum of Ten Dollars and other good and valuable consideration ($10.00) in hand paid by the City of Little Rock, Arkansas, for the use and benefit of the Little Rock Sanitary Sewer Committee, GRANTEE, the receipt of which is hereby acknowledged, does grant, bargain, sell and convey unto the said GRANTEE and unto its successors and assigns forever the following described land, situated in Pulaski County, Arkansas: A parcel of land situated in the NW 1/4 NE 1/4 and also in the NE 1/4 NW 1/4, in Section 21, Township 1 North, Range 11 West of the Fifth Principal Meridan, City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: Commencing at the Northeast Corner of Section 21, Township 1 North, Range 11 West of the Fifth Principal Meridan; thence along the North line of said Section 21, N 88 047131" W, 1312.43 feet to the NW Corner of the NE 1/4 NE 1/4 of said Section 21; thence continuing along said North line of Section 21, N 88 047131" W, 1215.41 feet; thence S O1 012129" W, 60.00 feet to a point which is the intersection of the South right -of -way line of Frazier Pike and the West line of a utility easement, said point also being the Point of Beginning; thence along said West easement line, S 17 °39'29" W, 155.63 feet; thence N 88 °47131 W, 79.47 feet; thence N O1 °12'29" E, 149.25 feet to a point on the South right -of -way line of Frazier Pike; thence along said South right -of -way line, S 88 °47'31" E, 123.54 feet to the Point of Beginning, and containing 0.35 acres, more or less. This conveyance is subject to all recorded easements and restrictions and the GRANTOR also assigns unto the GRANTEE all of its rights, title and interest in the easements set forth on Appendix "A" attached hereto. 197 TO HAVE AND TO HOLD The same unto the said GRANTEE Little Rock Sanitary Sewer Committee and unto its successors and assigns forever, with all appurtenances thereunto belonging. And GRANTOR hereby covenants with the said GRANTEE that it will forever warrant and defend the title to said lands against all claims whatever. IN TESTIMONY WHEREOF, the name of the GRANTOR is hereunto affixed by its Mayor and attested and its seal affixed by its Clerk, this 117tly day of 1982.
