RESOLUTION NO. 7,120
A RESOLUTION AUTHORIZING THE MAYOR AND
CITY CLERK TO ENTER INTO AN AGREEMENT
TO TRADE PART OF GILLAM PARK FOR LAND
IN THE FOURCHE BOTTOMS.
WHEREAS, the City of Little Rock is attempting to acquire
various properties for the Fourche Drainage (Plan 7) Project;
and,
WHEREAS, there are 21.95 acres of land in the south part of
Gillam Park that are not included in the Master Parks Plan; and
WHEREAS, Granite Mountain Quarries owns approximately 131
acres in the Fourche Bottoms that the City needs for the Plan 7
Project;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor and the City Clerk are hereby
authorized to execute the necessary deeds and documents attached
as Exhibits A & B hereto for trading 21.95 acres of land in the
south part of Gillam Park for 131 plus acres in the Fourche
Bottoms.
SECTION 2. The Mayor and the City Clerk are hereby
authorized to grant an easement attached as Exhibit C hereto for
the relocation of a gas line.

EASEMENT

FOR AND IN CONSIDERATION of the sum of $10.00, the
receipt of which is hereby acknowledged, the City of Little
Rock, Arkansas, a municipal corporation organized and
existing under and by virtue of the laws of the State of
Arkansas, Grantor, pursuant to Resolution No. 7,120, adopted
'December 20, 1983, does hereby grant to the Arkansas
Louisiana Gas Company, its successors, or assigns, an
easement to lay, maintain, alter, repair, operate and remove
pipelines for the transportation of oil or gas, or products
of oil or gas, and erect, maintain and operate telegraph and
telephone lines, and to construct Meter Houses and other
appurtenances if the same shall be found necessary on, over
and through certain lands situated in the County of Pulaski,
State of Arkansas, described as follows:
An easement 40 feet in width with the centerline
described as follows:
Beginning at a point 2,294.17 feet West of the
Southeast corner of Section 23, Township 1 North, Range
12 West; thence North 1,080 feet along a line parallel
to the North -South section line of Section 23; thence
easterly 2,284.17 feet along a line parallel to the
South section line of Section 23; thence South 1,080
feet along and 10 feet West of, and parallel to the
East section line of said Section 23 to a point on the
South section line of said Section 23, 10 feet West of
the Southeast corner of said Section 23.
With ingress and egress to and from the same. The said
Grantor, successors or assigns, to fully use and enjoy the
said premises except for the purposes hereinbefore granted
to the said Grantee, who hereby agrees to pay any damages

which may arise to timber, crops and fences from laying,
maintaining and operating said lines, said damage if not
mutually agreed upon, to be ascertained and determined by
three disinterested persons, one thereof to be appointed by
the said Grantor, successors or assigns, one by said 248
Grantee, successors or assigns, and the third by the two so
appointed as aforesaid, and the award of three such persons
shall be final and conclusive. Should more than one
pipeline be laid under this grant at any time, the same
consideration shall be paid for each line so laid as was
paid for the first line laid.
IN WITNESS WHEREOF, The name of the Grantor is hereunto
affixed by its Mayor and its seal affixed by its City Clerk
this day of 1983.
