A RESOLUTION AUTHORIZING THE CITY MANAGER
TO ENTER INTO CONTRACTS FOR INSURANCE FOR
THE CITY OF LITTLE ROCK.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Insurance coverage for the City of Little Rock
shall be awarded as follows:
(1) Arkansas Municipal League — Public Official
Liability Insurance and Vehicle Liability Insurance.
(2) Rebsamen Insurance Company for Property
Insurance and Electronic Data Processing Equipment Insurance per
the attachment.
SECTION 2. The City Manager is directed to enter into any
and all agreements necessary to execute such contract awards.

SUBJECT: Awarding of Contracts for Insurance Coverages
RECONNENDATION:

It is recommended that a Resolution be adopted awarding contracts
for insurance coverages as follows:
1. Arkansas Municipal League — Public Official Liability
Insurance and Vehicle Liability Insurance.
2. Rebsamen Insurance — Property Insurance and Electronic
Data Processing Equipment Insurance.
BACKGROUND DATA:
Like all cities, the City of Little Rock for the past two years
has struggled to provide a reasonable amount of insurance
coverage to protect the public, city officials, and city assets.
The cost of all forms of insurance have skyrocketed primarily
because of the multitude of law suits that. have been filed and
unusually large judgments awarded. Even though Little Rock's
loss experience has been low, costs have remained high.
Prior to the approaching anniversary date (October 1, 1986) of
the Metroplan Cooperative Insurance Agreement the City took bids
on various coverages. See attached tabulation of bids. After
receiving four bids we realized there was no absolute way to
compare bids for different types of coverage. First and foremost
for consideration was a decision to drop general liability
coverage that had been carried with Metroplan because of the
expense, and the fact Arkansas is one of four remaining states
that provides tort immunity. Other major decisions dealt with
the adequacy of the Arkansas Municipal League's Legal Defense
Program and the Fred S. James' bid which included a $50,000
deductible clause with no law enforcement coverage.

Following is a list of reasons why staff, with advice from
John Garrett of Marsh & McLennon, is making the recommendations
shown on the attached bid tabulation.
Public Official Liability Coverage
The Municipal League Legal Defense Program is recommended
because costs are lower and the background of work that has
been handled through the Arkansas Municipal League. Over the
past few years they have become experienced with this type of
litigation; they involve the City Attorney's office in each
case; and total cost for the program is $71,473.60 which we
feel is reasonable for the coverage. The coverage currently is
$250,000 plus a portion of the Municipal League's $1,000,000
re- insurance pool in the event a judgement exceeds $250,000.
Vehicle Liability Insurance
The recommendation for the Arkansas Municipal League Vehicle
Insurance is based on the facts that:
(a) The cost is approximately $93,000 less than the
amount bid by Metroplan.
(b) The plan

We recommend the Property and Electronic Data Processing
Equipment Insurance be placed through Rebsamen Insurance
Company because:
(a) Even though the Arkansas Municipal League's bid was
less, the coverage is severely limited and would not
pay over $85,000 on any one claim.
(b) The bid submitted by Fred S. James Company contained
a higher deductible and a maximum limit of coverage
per occurrence of $2,500,000. The Rebsamen Insurance
plans are in accordance with bid specifications, and
each building carries a separate loss and limit
regardless of occurrences.
