HomeMy WebLinkAbout117901 2 3 4 5 6 7 •• RESOLUTION NO. 11,790 20040633- W/29/2BB4 83:48:33 66 PN Filed - - Official Records Recorded of in PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees f11.00 A RESOLUTION TO GRANT A FRANCHISE TO ARKANSAS CHILDREN'S HOSPITAL FOR A SKYWALK AND A TUNNEL ACROSS BATTERY STREET, TO SET CONDITIONS FOR THE FORMAL FRANCHISE TO BE GRANTED; AND FOR OTHER PURPOSES. s WHEREAS, Arkansas Children's Hospital serves a vital role both locally and 9 nationally in the provision of quality medical care to children, and 10 WHEREAS, as a part of expansion efforts for the hospital it has been deemed 11 appropriate and necessary to build a skywalk across Battery Street and to build a tunnel 12 under Battery Street, and 13 WHEREAS, as demonstrated on the attached drawing this can be accomplished 14 with a franchise from the City for these locations as soon as a final legal description is 15 provided, and 16 WHEREAS, further delay in the construction of the project would be detrimental to 17 the project and its costs to the hospital and the citizens, 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 19 THE CITY OF LITTLE ROCK, ARKANSAS: 20 Section 1. The City Manager and City Clerk are authorized to execute documents 21 acceptable to the City Attorney which grants a formal franchise to Arkansas Children's 22 Hospital, or the appropriate named parent organization, across Battery Street in 23 substantially the same location as that shown on the drawing attached to this 24 resolution. 25 Section 2. When a formal legal description for the affected property, is, 26 to the City Attorney, a formal franchise which can be filed of record w.t' e Pulask [PAGE 1 OF 21 Grant of franchise to Arkansaa Children's Hospital for skywalk and tunnel on Battery Street r• 1 County Circuit Court and Recorder can be executed, provided that for purposes of 2 construction and any necessary building permits this resolution shall be sufficient 3 authorization for the hospital to proceed to obtain such permits. 4 , Section 3. The parties understand that a formal franchise will be subject to 5 appropriate building codes, utility relocation policies, and other policies of the City of 6 Little Rock, Arkansas. 7 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 8 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 9 unconstitutional, such declaration or adjudication shall not affect the remaining to portions of the resolution which shall remain in full force and effect as if the portion so 11 declared or adjudged invalid or unconstitutional was not originally a part of the 12 resolution. 13 Section 5. Repealer.
