HomeMy WebLinkAbout117560 • 1 RESOLUTION NO. 111756 PC 3 A RESOLUTION TO AUTHORIZE THE MAYOR TO EXECUTE A 4 MEMORANDUM OF AGREEMENT BETWEEN PULASKI 5 COUNTY, NORTH LITTLE ROCK, JACKSONVILLE, 6 MAUMELLE, SHERWOOD AND LITTLE ROCK TO STUDY 7 EXISTING AND FUTURE EMERGENCY COMMUNICATION 8 NEEDS; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the 2004 Limited Obligation Capital Improvement Bond Issue 1 I authorized $8,275,000 to upgrade the City's Police and Fire Radio System, and 12 WHEREAS, other local governments in Pulaski County use the City's system for 13 their communications and will have to consider improvements to their systems, and 14 WHEREAS, a proposed Memorandum of Agreement between Pulaski County, 15 North Little Rock, Jacksonville, Maumelle, Sherwood and Little Rock, attached hereto as 16 "Exhibit A ", provides for benefits of developing a joint emergency communication 17 system for the Pulaski County area, and 18 WHEREAS, the initial cost to the City of Little Rock for the consultant study is 19 Eighteen Thousand, Seven Hundred Fifty and no /100 Dollars ($18,750.00). 20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 21 THE CITY OF LITTLE ROCK, ARKANSAS: 22 Section 1. The Mayor is hereby authorized to execute a Memorandum of 23 Agreement, in substantially the form of Exhibit B, between Pulaski County, North Little 24 Rock, Jacksonville, Maumelle, Sherwood and Little Rock for a study to develop a 25 combined emergency communication system for the Pulaski County area, at a cost to 26 Little Rock of Eighteen Thousand, Seven Hundred Fifty and no /100 Dollars ($18,750.00). Funds for this project are to be allocated from the $70,635,000 Limited Obligation Capital Improvement Bond Issue (Series 2004). Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 4. Repealer. All ordinances and resolutions inconsistent with this resolution are hereby repealed to the extent of such inconsistency. Carpenter, Cit Attorney H H H H H H H Resolution Memorandum of Understanding for Emergency Communication System t Jim iley, Mayor [PAGE 2 OF 4] 0 • 1 MEMORANDUM OF AGREEMENT 2 This Memorandum of Agreement is entered into on this _ day of 3 2004, by and between Pulaski County, Arkansas (County) and the Cities 4 of Little Rock, North Little Rock, Jacksonville, Maumelle and Sherwood (Cities) 5 pursuant to the authority of Arta. CODE ANN. X25 -20 -101 et seq., and will become binding 6 on all parties upon ratification by the Quorum Court of Pulaski County, Arkansas and 7 the various City Councils or Boards of Directors of the Cities. WITNESSETH: 8 9 WHEREAS, the County and Cities of Pulaski County are going to expend a 10 considerable sum to upgrade the existing emergency communications systems; and, 11 12 WHEREAS, it is therefore timely to review the system in its entirety; and 13 14 WHEREAS, the County and Cities desire to enter into a contractual agreement 15 whereby County/City funds are made available for a study of existing and future 16 emergency communication needs and the feasibility of a combined emergency 17 communications system for the Pulaski County area. 18 19 IT IS THEREFORE hereby agreed that: 20 21 Section 1. A consultant will be hired to analyze existing and future 22 emergency communications system needs and to prepare a preliminary description of a 23 combined system for the Pulaski County area. The emergency communications systems 24 to be considered include those serving law enforcement, fire protection, emergency 25 services, and 911 call centers. 26 27 Section 2. The anticipated cost to the parties for the consultant study is Seventy- 28 Five Thousand Dollars ($75,000.00). The parties agree to pay the following: 29 30 Pulaski County $18,750.00 31 City of Little Rock $18,750.00 32 City of North Little Rock $18,750.00 33 City of Maumelle $ 6,250.00 34 City of Sherwood $ 6,250.00 35 City of Jacksonville $ 6,250.00 36 37 Section 3. A committee will be appointed to oversee the implementation of and 38 operation of this agreement. The committee will consist of the Chief Executive Officers 39 of each participating entity, or their designees; the Pulaski County Sheriff, or his [PAGE 3 OF 4] Resolution Memorandum of Understanding for Emergmry Communication System 0 0 1 designee; the chief law enforcement and fire protection officers of each participating 2 entity, or their designees; and a representative of Metropolitan Emergency Medical 3 Services (MEMS). 4 5 Section 4. The City of Little Rock agrees to handle the procurement of the 6 consulting services in accordance with appropriate purchasing procedures. Once the 7 bid or request responses are received, the committee will meet to select the consultant to 8 be hired. 9 10 Section 5. The County and Cities agree that should the need for combined 11 services extent to other entities or areas the terms of this agreement may be amended to 12 include those other entities or areas. 13 14 Section 6. If any of the entities fail to ratify this agreement, the other parties may 15 enter into the agreement with respect to the remaining parties only. 16 17 Section 7. Notwithstanding anything contained in this Agreement to the 18 contrary, if any governmental body fails to appropriate funds for subsequent periods 19 within the term of this Agreement, that governmental entity shall riot be obligated to 20 make payments beyond the then - current fiscal appropriation period provided that once 21 an appropriation is made, the entity is obligated to provide funds for that appropriation 22 period.
