HomeMy WebLinkAbout11687RESOLUTION NO. 11,687 • 2 3 A RESOLUTION TO AUTHORIZE THE SALE OF 2004015016 02/24/2004 03:21:54 PH Filed 8 Recorded in Official Records of CAROLYN STALEY PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $14.00 LOT 11, 4 BLOCK 112, AND THE NORTH THREE (3) FEET OF LOT 101 5 BLOCK 112, ORIGINAL CITY OF LITTLE ROCK, TO THE 6 STATE OF ARKANSAS FOR THE APPRAISED VALUE OF 7 $75,000 AND TO AUTHORIZE THE MAYOR AND CITY CLERK 8 TO EXECUTE A DEED FOR THE PROPERTY; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS, in the interests of saving the historic structure that is the Mosaic 12 Templars building at 9th and Broadway Streets from demolition or inappropriate 13 development, the Little Rock Board of Directors passed Little Rock, Ark. Resolution 14 ( "LRR ") No. 8,842 on December 30, 1992, authorizing the City to purchase the Mosaic 15 Templars building and grounds under certain circumstances, and 16 WHEREAS, one of the conditions of the purchase was that the City execute a 17 lease of the lot to the south of the building ( "Lot 11 ") under a five (5) -year term with a 18 mandatory option to purchase Lot 11 if development and construction work is 19 commenced on the Mosaic Templars building during the lease term, and 20 WHEREAS, after the unavailing attempts of the Mosaic Templars Society to pay 21 for the cost of renovation and operation of the building before the January 15, 1999 22 deadline, the City, due to its commitment to save the historic structure, decided to begin 23 construction and development work in place of the Society and exercised the option to ,ew[a i�LV }ti 24 purchase Lot 11, and is '�. �/' _,r?1' :mow. i. �'• f. it •:Y'•' '4.���{3y \'Y �/r° [Page 1 of 31 Resolution s� To a Whorize sale of lot to State of Arkansas rbe. /G�I%ItC`1`l.p for Mosaic Templars Building ge•ee•vvv� 2 3 4 5 6 7 8 9 10 11 12 13 14 0 0 WHEREAS, the City conveyed the Mosaic Templars building and grounds to State of Arkansas, Department of Arkansas Heritage, on April 1, 2003 for rehabilitation and use as a center for African American culture and business enterprise, and WHEREAS, the State of Arkansas desires to purchase Lot 11, Block 112 and the north three (3) feet of Lot 10, Block 112, Original City of Little Rock, (the 'Property ") for the appraised value of Seventy Five Thousand Dollars ($75,000) so that it may add a fire escape to the Mosaic Templars building for the protection of the general public and so that it may otherwise enhance the use of the historic Mosaic Templars building, and WHEREAS, the Little Rock Board of Directors deems it appropriate and in the best interests of the public health, safety and welfare for the City to enter into a contract for sale of the Property to the State of Arkansas for a total purchase price of Seventy Five Thousand Dollars ($75,000). NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 15 Section 1. The sale of property, described as Lot 11, Block 112,and the north 16 17 18 19 20 21 22 23 24 25 26 27 three (3) feet of Lot 10, Block 112, Original City of Little Rock, Arkansas, to the State of Arkansas for its appraised value of $75,000 is hereby authorized. The Mayor and City Clerk are hereby authorized to execute a deed, in a form acceptable to the City Attorney, to the Property on behalf of the City, and they and the City Manager are authorized to take any other actions necessary to effect the sale of the Property to the State of Arkansas. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
