9 DOWNTOWN PARTNERSHIP IN TERMS OF FACILITIES FOR THE
10 HOMELESS; TO DECLARE THE INTENTION OF THE BOARD TO SEEK
11 IMPLEMENTATION OF APPROPRIATE GUIDELINES AND
12 PROVISIONS OF THIS REPORT AND OTHER INFORMATION
13 GATHERED BY THE CITY; AND FOR OTHER PURPOSES.

15 WHEREAS, in Little Rock, Ark., Resolution No. 11,545 Quly 1, 2003) ( "LRR
16 11,545 "), the Board of Directors created a moratorium until August 12, 2003, on the
17 issues of building permits or occupancy permits for residential treatment facilities and
18 temporary housing facilities located within the City, and
19 WHEREAS, on August 12, 2003, the Board received a report from a citizen
20 committee with recommendations on how to approach issues concerning facilities for
21 the homeless, and
22 WHEREAS, with the exception of property already purchased by the Union
23 Rescue Mission, which was properly zoned for such a facility for the homeless at the
24 time of the purchase, the City is unaware of any other such facilities that have��df!ivally - "-

I WHEREAS, the Board wishes to continue the current moratorium for residential
2 treatment and temporary housing facilities for the homeless until September, 30, 2003,
3 to provide the Board time to consider any possible amendments to the zoning
4 ordinances that would be necessary to implement these changes, and to provide notice
5 to parties to any potential property purchases that the City is considering proposed
6 ordinance amendments which may impact a final decision on whether to purchase such
7 property,
8 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
9 THE CITY OF LITTLE ROCK, ARKANSAS:
10 Section 1. The moratorium on the issuance of building permits or occupancy
11 permits for residential treatment or temporary housing facilities established in Little
12 Rock, Ark., Resolution No. 11,545 (July 1, 2003) shall be extended to and including
13 September 30, 2003.
14 Section 2. The provisions of this resolution shall not apply to any such facility
15 for which property was already purchased as of July 1, 2003; further, nothing in this
16 resolution shall apply to any such . permits sought for existing facilities that are
17 undergoing repairs or rehabilitation only.
18 Section 3. The Board directs the City Manager to review the report submitted
19 on this date by the task force of the Downtown Partnership, to determine if the City
20 needs to make any amendments to its Code of Ordinances, and if so, to recommend
21 such statements in sufficient time prior to September 30, 2003, that there can be public
22 notification and hearing about these proposed changes.
23 Section 4. The Board of Directors states its intent to establish a uniform policy
24 about the siting of such facilities without providing for any action that would be
25 contrary to state or federal constitutional provisions, or in contravention of the federal
26 Fair Housing Act.

1 Section 5. Severability. In the event any title, section, paragraph, item,
2 sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid
3 or unconstitutional, such declaration or adjudication shall not affect the remaining
4 portions of the resolution which shall remain in full force and effect as if the portion so
5 declared or adjudged invalid or unconstitutional was not originally a part of the
6 resolution.
7 Section 6. Repealer. All laws and parts of laws inconsistent with the
8 provisions of this resolution are hereby repealed to the extent of such inconsistency.
