HomeMy WebLinkAbout115520 0 1 RESOLUTION NO. 11,552 01 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY 4 CLERK TO EXECUTE APPROPRIATE DOCUMENTS TO 5 TRANSFER CERTAIN REAL PROPERTY TO THE UNITED 6 STATES ARMY CORPS OF ENGINEERS FOR FLOWAGE 7 EASEMENTS; AND FOR OTHER PURPOSES. 0 9 WHEREAS, the United States Army Corps of Engineers needs to acquire a 10 flowage easement along the Arkansas River on land owned by Little Rock Parks and 11 Recreation, and 12 WHEREAS, the City has worked with the Corps of Engineers on similar 13 easements in the past, and 14 WHEREAS, the Corps of Engineers has agreed to pay the City a fair market 15 value of Nine Hundred Dollars ($900.00) for the property which will be placed in the 16 Parks Land Acquisition, and 17 WHEREAS, the easement will not adversely affect the Jimmerson Creek or River 18 Mountain Parks, and 19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 20 THE CITY OF LITTLE ROCK, ARKANSAS:' 21 Section 1. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. Our records indicate you own land set forth in the attached descriptions, containing 1.93 acres, Pulaski County, Arkansas. In compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, Public Law 91 -646, as amended, we are advising you that an informal value estimate has been prepared by our staff appraiser. The total amount estimated as the value of the easement is $900.00 and allocated as follows: TOTAL 180E -1 1.25 $ 600.00 180E -2 D-68 _30000 1.93 $ 900.00 This estimate was made by a qualified staff real estate appraiser based upon comparable sales in the area of your property and other easements we have purchased in the area. This amount does not reflect any consideration of or allowance for any relocation assistance and payments under Public Law 91 -646, as amended, to which you may be entitled. If you disagree with this estimate, you may request a formal appraisal of your property. A formal appraisal may result in an increase or a decrease from this estimate. Three copies of an Offer to Sell Easement are enclosed for your consideration. If you find the offer acceptable, please sign-and reh,rn two copies to us in the enclosed postage -free, self - addressed envelope. A copy may be retained for your records.
