3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 EXECUTE A CONTRACT WITH ROSE AUSTIN AS PART OF THE
5 CENTRAL HIGH TARGETED NEIGHBORHOOD ENHANCEMENT
6 PLAN TO CONSTRUCT A SINGLE FAMILY RESIDENCE AT 1700
7 BATTERY STREET IN THE APPROVED CENTRAL HIGH TNEP
8 AREA.

10 WHEREAS, the City has been granted authority to contract with owners of property to agree to
I l live in residential dwellings in targeted neighborhoods for a period of five (5) years, and to use the
12 consideration for such agreements to construct or rehabilitate residential structures in an effort to
13 recapture or rehabilitate neighborhoods that have become urban blight, or that could become an area of
14 blight if such actions are not taken, and
15 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. §§ 14 -169-
16 1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the Act "), the City Board
17 of Directors has completed the process and determined that an area in the downtown portion of the City
18 qualifies as a targeted neighborhood as defined by the Act, and
19 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted Little Rock,
20 Ark., Ordinance No. 18,072 Quly 27, 1999), and designated this portion of the City as the Central High
21 Targeted Neighborhood Enhancement Plan area (hereinafter referred to as the "Central High TNEP "),
22 and
23 WHEREAS, the Central Little Rock CDC is constructing a new structure in this area and Rose
24 Austin has submitted an appropriate application to contract with the City to purchase the said structure
25 and to provide an owner occupied residential structure within the boundaries of the Central High TNEP,
26 and the City hereby agreed to a contract with the Owner in the amount of SEVEN THOUSAND
27 DOLLARS ($7,000.00), subject to pending bank approval, and
28 WHEREAS, the City desires to contract with the Owner pursuant to the Central High TNEP
29 program, and the Owner desires to assure the residency requirements of the TNEP program are met so
30 this neighborhood can be recaptured and a meaningful residential area can be developed,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK ARKANSAS:
Section 1. The City Manager is authorized to execute a contract with Rose Austin for the
completion of the construction of the residence at 1700 Battery Street in the approved Central High TNEP
area.
Section 2. This action authorizes a $7,000.00 contract between the City of Little Rock and Rose
Austin to complete construction of a residence at 1700 Battery Street in the Central High TNEP area,
which sum represents not more than twenty percent (20 %) of the total project cost.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
resolution.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
Section 5. This resolution shall be in full force and effect from and after its adoption.
