3 A RESOLUTION RELEASING AN EASEMENT FOR PUBLIC UTILITY
4 AND DRAINAGE PURPOSES RETAINED IN A STREET RIGHT -OF-
5 WAY ABANDONED IN LITTLE ROCK, ARK. ORDINANCE NO. 18,751;
6 AND FOR OTHER PURPOSES.

8 WHEREAS, on September 17, 2002, the Little Rock Board of Directors passed Little
9 Rock, Ark. Ordinance No. 18,751 ( "LRO 18,751 "); and
10 WHEREAS, LRO 18,751 closed and abandoned to public vehicular traffic a portion of
11 Easement Deed No. 80 -23031 between Stagecoach Road and Quail Run Drive in Otter Creek
12 Addition; and
13 WHEREAS, LRO 18,751- retained in the City an easement in the abandoned right of way
14 for public utility and drainage purposes; and
15 WHEREAS, the petitioner has requested that the Little Rock Board of Directors remove
16 and abandon the utility and drainage easement as the easement is not needed for drainage
17 purposes nor the utilities for which it was reserved, there is no longer a street planned to be built
18 within the former easement, and a building has been constructed over a portion of the easement
19 which would preclude the use of the former easement for utility and drainage purposes.
20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
21 THE CITY OF LITTLE ROCK ARKANSAS:
22 Section 1. The City hereby unconditionally abandons and removes the public utility and
23 drainage easement formerly located in the street right -of -way abandoned in LRO 18,741 and
24 described as follows:

26 Easement Deed #80 -23031 — between Stagecoach Road
27 and Quail Run Drive, Otter Creek Addition to the City
28 of Little Rock, Arkansas.
29 Section 2. Severability. In the event any title, section, paragraph, item, �sen(,eg6,.,sclause,

remain in full force and effect as if the portion so declared or adjudged invalid or
unconstitutional was not originally a part of the resolution.
Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
inconsistent with the provisions of this resolution are hereby repealed to the extent of such
inconsistency.
Section 4. This resolution shall be in full force and effect from and after its adoption.
