3 A RESOLUTION AUTHORIZING THE SALE OF
4 CERTAIN REAL PROPERTY LOCATED IN THE
5 LITTLE ROCK PORT INDUSTRIAL PARK;
6 AUTHORIZING THE MAYOR AND CITY CLERK
7 TO EXECUTE A WARRANTY DEED FOR THE
8 CONVEYANCE; AND FOR OTHER PURPOSES.

10 WHEREAS, Cracker Box, L.L.C., an Arkansas corporation (the "Purchaser ") desires to
11 purchase certain real property located in the Little Rock Port Industrial Park owned by the City
12 of Little Rock, Arkansas (the "City "); and
13 WHEREAS, Purchase has made an offer in the sum of One Hundred Thousand and
14 no /100 Dollars ($100,000.00) for the property; and
15 WHEREAS, the Little Rock Board of Directors finds that the proposed sale to the
16 Purchaser will help secure and develop industry in the Little Rock Port Industrial Park, thereby
17 providing substantial employment and payroll.
18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
19 THE CITY OF LITTLE ROCK, ARKANSAS:

21 Section 1. The sale of the property for the consideration stated above is approved and
22 the Mayor and City Clerk are authorized and directed to execute for and on behalf of the City a
23 Warranty Deed and the appropriate plat and bill of assurance, conveying the property to the
24 Purchaser or its designee, upon full payment of the purchase price in the sum of One Hundred
25 Thousand and no /100 Dollars ($100,000.00) paid to the Little Rock Port Authority.
26 Section 2. The property is substantially described as follows, with such changes as
27 shall be approved by the City Attorney and the Mayor, the execution of the Warranty Deed
28 authorized by this resolution shall constitute evidence of such approval:
29 A parcel of land located in the NE 1/4, SE' /. and the SE 1/4, NE' /< of section 16, T-
30 1 -N, R -11 -W, City of Little Rock, Arkansas, being more particularly described as
31 follows:

33 Commencing at the NW corner of said NE '/4, SE '/.; thence N 58 degrees 17'32"
34 E 28.09' to the intersection of the East Right -of -Way line of Fourche Dam Pike
35 Road with the South Right -of -Way of the Little Rock Port Railroad spur; thence
36 along the South Right -of -Way line of said Railroad spur N 78 degrees 43'34" E
37 322.19' to the point of beginning (said point also being the NE comer of Tract C
38 Area 203, Little Rock Port Industrial Park); thence along the South Right -of -Way
39 line of said Railroad Spur N 78 degrees 43'34" E 100.00'; thence S 11 degrees

16'28" E 380.0 a point on the North Right -of -W ne of Lindsey Road;
thence S 78 deg es 43'34" W along said North Right- Way line of Lindsey
Road 100.00' (said point also being the SE comer of Tract C Area 203, Little
Rock Port Industrial Park); thence N 11 degrees 16'28" W 380.04' to the point of
beginning, containing 0.872 acres more or less.
