HomeMy WebLinkAbout112060 �J 1 RESOLUTION NO. 11,206 2 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO 4 EXECUTE A CONTRACT WITH BEVERLY PARKER AS PART 5 OF THE TORNADO DISASTER REBUILD TARGETED 6 NEIGHBORHOOD ENHANCEMENT PLAN TO CONSTRUCT A 7 NEW A SINGLE FAMILY RESIDENCE AT 3120 DR. MARTIN 8 LUTHER KING JR. DRIVE IN THE APPROVED TORNADO 9 DISASTER REBUILD TNEP AREA. 10 11 WHEREAS, the City has been granted authority to contract with owners of 12 property to agree to live in residential dwellings in targeted neighborhoods for a 13 period of five (5) years, and to use the consideration for such agreements to 14 construct or rehabilitate residential structures in an effort to recapture or 15 rehabilitate neighborhoods that have become urban blight, or that could become 16 an area of blight if such actions are not taken, and 17 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. 18 Code Ann. §§ 14-169 -1101 to 1108 (Michie Repl. 1998), as may be amended) 19 (hereinafter referred to as "the Act "), the City Board of Directors has completed 20 the process and determined that this area in the City qualifies as a targeted 21 neighborhood as defined by the Act, and 22 WHEREAS, after fulfillment of the statutory requirements to do so, the 23 City adopted Little Rock, Ark., Ordinance No. 18,387 (November 14, 2000), and 24 designated this portion of the City as the Tornado Area Disaster Rebuild 25 Targeted Neighborhood Enhancement Plan area (hereinafter referred to as the 26 "Tornado Area TNEP "), and [PAGE 1 OF 31 Resolution Parker TNEP 0 1 WHEREAS, the Applicant, Beverly Parker, has submitted an appropriate 2 application to contract with the City to provide an owner occupied residential 3 structure within the boundaries of the Tornado Area TNEP in the amount of 4 FOURTEEN THOUSAND SEVEN HUNDRED DOLLARS ($14,440.00), and 5 WHEREAS, the City desires to contract with the Applicant pursuant to the 6 Tornado Area TNEP program, and the Applicant desires to assure the residency 7 requirements of the TNEP program are met so this neighborhood can be 8 recaptured and a meaningful residential area can be developed, 9 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF 10 DIRECTORS OF THE CITY OF LITTLE ROCK ARKANSAS: 11 Section 1. The City Manager is authorized to execute a contract with 12 Beverly Parker for the construction of a new home at 3120 Dr. Martin Luther 13 King Jr. Dr. in the approved Tornado Area TNEP. 14 Section 2. This action authorizes a $14,440 contract between the City of 15 Little Rock and Beverly Parker to support new construction activities at 3120 Dr. 16 Martin Luther King Jr. Dr. in the Tornado Area TNEP. 17 Section 3. Severability. In the event any title, section, paragraph, item, 18 sentence, clause, phrase, or word of this resolution is declared or adjudged to be 19 invalid or unconstitutional, such declaration or adjudication shall not affect the 20 remaining portions of the resolution which shall remain in full force and effect as 21 if the portion so declared or adjudged invalid or unconstitutional was not 22 originally a part of the resolution. All laws, ordinances, resolutions, or parts of the 2 same, that are inconsistent with the provisions of this resolution, are hereby 3 repealed to the extent of such inconsistency. 4 Section 5.
