HomeMy WebLinkAbout11202• 1 2 RESOLUTION NO. 11, 202 3 4 5 A RESOLUTION AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY 6 LOCATED IN THE LITTLE ROCK PORT INDUSTRIAL PARK; AUTHORIZING 7 THE MAYOR AND CITY CLERK TO EXECUTE A WARRANTY DEED FOR THE 8 CONVEYANCE AND ANY EASEMENTS OR OTHER DOCUMENTS DEEMED 9 NECESSARY FOR THE EXTENSION OF THE LITTLE ROCK PORT RAILROAD; 10 AND FOR OTHER PURPOSES. 12 WHEREAS, The Heifer Project International an Arkansas nonprofit corporation 13 (the "Purchaser ") desires to purchase certain real property located in the Little Rock Port 14 Industrial Park owned by the City of Little Rock, Arkansas (the "City"), and 15 WHEREAS, Purchaser has made an offer in the sum of One Hundred Eighteen 16 Thousand One Hundred Forty and no /100 Dollars ($118,140.00) less real estate 17 commission of $3,544.00, for the property and the Port Board of Directors has approved the 18 acceptance of the offer, and 19 WHEREAS, the Little Rock Board of Directors finds that the proposed sale to the 20 Purchaser will help to secure and develop industry in the Little Rock Port Industrial Park, 21 thereby providing substantial employment and payroll. 22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS 23 OF THE CITY OF LITTLE ROCK: 24 Section 1. The sale of the property for the consideration stated above is approved 25 and the Mayor and City Clerk are authorized and directed to execute for and on behalf of 26 the City a Warranty Deed and the appropriate plat and bill of assurance, conveying the 27 property to the Purchaser or its designee, and any easements required for the extension of 28 the Little Rock Port Railroad over adjacent lands of the City, upon full payment of the 29 purchase price in the sum of One Hundred Eighteen Thousand One Hundred Forty and 30 no /100 Dollars ($118,140.00), less real estate commission of $3,544.00, paid to the Little 31 Rock Port Authority. 32 Section 2. The property is substantially described as follows, with such changes as 33 shall be approved by the City Attorney and the Mayor, the execution of the Warranty Deed 34 authorized by this resolution shall constitute evidence of such approval: 0 0 1 2 A parcel of land located in the Northeast Quarter of the Northeast Quarter of 3 Section 20, Township 1 North, Range 11, West Pulaski County, Arkansas, being a 4 part of Area 102 as shown of Little Rock Port Industrial Addition to the City of 5 Little Rock, Pulaski County Arkansas, and being more particularly described as 6 follows: 7 Commencing at the Found RR SPK at the Northeast corner of the Northeast 8 Quarter of the Northeast Quarter of said Section 20, thence South 1° 57' 40" West. 9 A distance of 60.00 feet to the South right of way of Frazier Pike; Thence along said 10 right of way North 880 47' 31" west, a distance of 715.21 feet for a point of 11 beginning; Thence south 1° 57' 40" west, a distance of 1261.58 feet, (Record 12 1260.78) to the South line of said Northeast Quarter of the Northeast Quarter; 13 Thence along said South line North 88° 48' 52" West, a distance of 136.00 feet; 14 Thence North V 57' 40" East, a distance of 1261.63 feet to the South right of way of 15 Frazier Pike; Thence along said South right of way South 88° 47' 31" East, a 16 distance of 136.00 feet to the point of beginning; said described tract containing 17 3.938 acres, more or less. 18 Section 3. Conditions. This approval is conditioned upon the successful 19 negotiation and execution of the appropriate easements for the extension of the Little Rock 20 Port Railroad over the tract conveyed herein and over adjacent tracts, and upon the 21 successful negotiation and execution of the proper documents for permission to use the 22 existing Entergy power line easement to accommodate the extension of the railroad line 23 referenced herein. 24 Section 4. Severability. In the event any portion of this resolution is declared or 25 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect 26 the remaining portions of the resolution, which shall remain in full force and effect as if the 27 portion so declared or adjudged invalid or unconstitutional was not originally a part of this 28 resolution. 29 Section S. Repealer. All laws, ordinances and regulations and parts thereof in 30 conflict with this resolution are hereby repealed to the extent of such inconsistency. 31 Section 6.
