HomeMy WebLinkAbout1113011 • 1 RESOLU'T'ION NO. 11,130 2 3 A RESOLUTION AUTHORIZING TIIE CITY MANAGER TO EXECUTE A 4 CONTRACT WITH ERMA HENDRIX AS PART OF THE TORNADO 5 DISASTER REBUILD TARGETED NEIGHBORHOOD ENHANCEMENT 6 PLAN TO RENOVATE A SINGLE FAMILY RESIDENCE AT 921 7 ROOSEVELT ROAD IN THE APPROVED TORNADO DISASTER REBUILD 8 TNEP AREA. 9 10 WHEREAS, the City has been granted authority to contract with owners of property to 11 agree to live in residential dwellings in targeted neighborhoods for a period of five (5) years, and to 12 use the consideration for such agreements to construct or rehabilitate residential structures in an 13 effort to recapture or rehabilitate neighborhoods that have become urban blight, or that could 14 become an area of blight if such actions are not taken, and 15 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. §§ 14- 16 169 -1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the Act "), the 17 City Board of Directors has completed the process and determined that this area in the City qualifies 18 as a targeted neighborhood as defined by the Act, and 19 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted Little 20 Rock, Ark., Ordinance No. 18,387 (November 14, 2000), and designated this portion of the City as 21 the Tomado Area Disaster Rebuild Targeted Neighborhood Enhancement Plan area (hereinafter 22 referred to as the "Tornado Area TNEP"), and 23 WHEREAS, the Owner, Erma Hendrix, has submitted an appropriate application to 24 contract with the City to provide an owner occupied residential structure within the boundaries of 25 the Tornado Area TNEP in the amount of SEVEN THOUSAND FIVE HUNDRED SEVENTY 26 FOUR DOLLARS ($7,574.00), and 27 WHEREAS, the City desires to contract with the Owner pursuant to the Tornado Area 28 TNEP program, and the Owner desires to assure the residency requirements of the TNEP program 29 are met so this neighborhood can be recaptured and a meaningful residential area can be developed, 30 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 31 CITY OF LITTLE ROCK ARKANSAS: 32 Section 1. The City Manager is authorized to execute a contract with Erma Hendrix for the 33 renovation of the residence at 921 Roosevelt Road in the approved Tornado Area TNEP. 0 0 1 Section 2. This action authorizes a $7,574.00 contract between the City of Little Rock and 2 Erma Hendrix to support renovation activities at 921 Roosevelt Road in the Tornado Area TNEP. 3 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, 4 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such 5 declaration or adjudication shall not affect the remaining portions of the resolution which shall 6 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional 7 was not originally a part of the resolution. 8 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are 9 inconsistent with the provisions of this resolution are hereby repealed to the extent of such 10 inconsistency. 11 Section 5.
