HomeMy WebLinkAbout11127• • 1 RESOLUTION NO. 11.127 2 A RESOLUTION TO SET OCTOBER 16, 2001, AS THE DATE OF A 3 PUBLIC HEARING ON THE QUESTION OF WHETHER TO ABANDON 4 STREET RIGHT -OF -WAY BETWEEN ON EAST SECOND STREET 5 BETWEEN COLLINS AND GEYER STREET, ON BYRD STREET 6 BETWEEN EAST THIRD STREET AND THE ARKANSAS RIVER; ON 7 INDUSTRIAL STREET BETWEEN EAST SECOND STREET AND THE 8 ARKANSAS RIVER; ON ENGLISH AVENUE BETWEEN FROM EAST 9 SECOND STREET TO THE ARKANSAS RIVER, ALL IN THE 10 RUSSELL'S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS: 11 AND FOR OTHER PURPOSES. 12 13 WHEREAS, there has been a request to abandon certain City right -of -way in the 14 Russell's Addition to the City of Little Rock, Arkansas, to become a part of the William 15 Jefferson Clinton Presidential Park, and such abandonment requires that a public hearing 16 be held after publication of notice of such a hearing, 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 18 THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The Board of Directors will conduct a public hearing on Tuesday, 20 October 16, 2001, at 6:00 PM, or such time thereafter as the matter can be reached upon the 21 normal call of the agenda, on the question of whether to abandon existing street right of 22 way in the Russell Addition to the City of Little Rock, Arkansas, more particularly 23 described as follows: 24 (a) A strip that is 60 -feet wide by 1750 -feet long on East 2d Street, from 25 Collins Street to John Street; 26 (b) A strip on Byrd Street that is 60 -feet wide by 520 feet long from Easst 27 3'd Street to the Arkansas River Bank; PAGE 1 OF 2 0 0 1 (c) A strip that is 60 -feet wide and 400 -feet long on Industrial Drive from 2 East 2d Street to the Arkansas River Bank. 3 All persons who wish to be heard on the question of whether to abandon this right -of -way 4 shall be given the opportunity to appear and be heard. 5 Section 2. The City Clerk is directed to publish notice of this public hearing in 6 the manner required by law. 7 Section 3. The Board of Directors states that the intention to abandon this street 8 right -of -way is in order to include this property within the boundaries of the William 9 Jefferson Clinton Presidential Park. 10 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 11 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 12 unconstitutional, such declaration or adjudication shall not affect the remaining portions 13 of the resolution which shall remain in full force and effect as if the portion so declared or 14 adjudged invalid or unconstitutional was not originally a part of the resolution. 15 Section S. Repealer. All resolutions, bylaws, and other matters inconsistent with 16 this resolution are hereby repealed to the extent of such inconsistency. 17 ADOPTED: -.
