HomeMy WebLinkAbout110150 0 1 RESOLUTION NO. 11,015 7 3 A RESOLUTION AUTHORIZING THE MAYOR AND 4 CITY CLERK TO EXECUTE A DEED OF 24.78 5 ACRES TO DELTIC TIMBER CORPORATION; AND 6 FOR OTHER PURPOSES. 7 WHEREAS, on December 16, 1997, the Little Rock Board of Directors (the 8 "Board ") authorized an exchange of real property with Deltic Timber Corporation 9 "Deltic "), and 10 WHEREAS, the resolution authorized the City to exchange property that was 11 previously dedicated to the City by Deltic, for a 24.78 acre tract of ground Deltic owned 12 and was deemed by the City to be more suitable for City purposes, and 13 WHEREAS, the City and Deltic executed an Exchange Deed on December 22, 14 1997, in which the City acquired the 24.78 acre parcel and exchange other property 15 owned by the City to Deltic, and 16 WHEREAS, Deltic has expressed its desire to have the City sell the 24.78 acre 17 parcel back to Deltic for Twenty Thousand and no/ 100 Dollars ($20,000.00) per acre, 18 and 19 WHEREAS, the Board deems it appropriate to convey the property back to 20 Deltic for Twenty Thousand and no/ 100 Dollars ($20,000.00) per acre which purchase 21 price is to be used by the City toward purchase of an alternative park site for west Little 22 Rock. 23 . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF 24 DIRECTORS OF THE CITY OF LTI"TLE ROCK, ARKANSAS: 25 Section 1. The Mayor and City Clerk are authorized to execute a deed in 26 substantially the form attached hereto as Exhibit "A ", upon the approval of the City 27 Attorney, for the sale of 24.78 acres of property to Deltic Timber Corporation. In the event any title, subtitle, section, subsection, 2 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this 3 resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 4 adjudication shall not affect the remaining portions of the resolution which shall remain 5 in full force and effect as if the portion so declared or adjudged invalid or 6 unconstitutional was not originally a part of the resolution. 7 Section 3. Repealer.
