1 RESOLUTION NO. 11,011
2 A RESOLUTION TO GRANT AN EASEMENT IN ALLSOPP PARK FOR
3 THE USE OF ENTERGY ARKANSAS, INC.; AND FOR OTHER
4 PURPOSES.
5 WHEREAS, Entergy Arkansas, Inc., the only electric power entity serving residents in
6 this area, wishes to install underground electric lines to serve customers in the Allsopp Park
7 area, and such preferred service is in the best interests of the City because it decreases the
S chance of problems created by falling or severed power lines,
9 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
10 THE CITY OF LITTLE ROCK, ARKANSAS:
11 Section 1. The City Manager and City Clerk, upon receipt of a one thousand dollar
12 ($1,000.00) payment by Entergy Arkansas, Inc., are authorized to execute and deliver a 10 -foot
13 wide easement for an area of Allsopp Park roughly described as running from the intersection
14 of Crestwood Drive and Kavanaugh Boulevard to the Edge Hill Subdivision, provided the
15 easement agreement -- including the legal description -- is in a form acceptable to the City
16 Attorney.
17 Section 2. Severability.. In the event any title, section, paragraph, item, sentence.,
18 clause, phrase, or word of this resolution is declared or adjudged to be- invalid or
19 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the
20 resolution which shall remain in full force and effect as if the portion so declared or adjudged
21 invalid or unconstitutional was not originally a part of the resolution.
22 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
23 inconsistent with the provisions of this resolution are hereby repealed to the extent of such
24 inconsistency, provided that nothing in the grant of this easement shall be deemed to modify,
25 decrease, or otherwise impact the requirements Entergy Arkansas, Inc., must meet as a part of
26 the utility franchise agreement it has with the City.
