RESOLUTION NO. 11,003
3 A RESOLUTION TO AUTHORIZE AN EASEMENT
4 AGREEMENT WITH RELIANT ENERGY- ARKI.A FOR AN
5 AREA NEAR GILLAM PARK; AND FOR OTHER PURPOSES.

7 WHEREAS, Reliant Energy - Arkla has a franchise agreement with the City for the
S use of certain City right -of -way, and
9 WHEREAS, it has been determined that it also needs an easement for the
10 placement of certain facilities along the edge of Gillam Park and I -440, and
11 WHEREAS, an appropriate fee has been negotiated for this limited use of this
12 portion of the park property,
13 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
14 OF THE CITY OF LITTLE ROCK, ARKANSAS:
15 Section 1. The appropriate City officials, including but not limited to the Mayor,
16 City Manager, and City Clerk, are authorized to execute documents which would grant a
17 utility easement to Reliant Energy - Arkla in a portion of Gillam Park near I -440, provided
18 the legal form of such easement is approved by the Office of the City Attorney.
19 Section 2. The approval of this easement is supplemental to, and will incorporate
20 by reference all, of the various terms and provisions of the utility franchise agreement the
21 City maintains with Reliant Energy - Arkla.
22 Section 3. Severability. In the event any title, section, paragraph, item,
23 sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or
24 unconstitutional, such declaration or adjudication shall not affect the remaining portions
25 of the resolution which shall remain in full force and effect as if the portion so declared or
26 adjudged invalid or unconstitutional was not originally a part of the resolution.
27 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
28 are inconsistent with the provisions of this resolution are hereby repealed to the extent of
29 such inconsistency.
