RESOLUTION NO. 10,983.
3 A RESOLUTION TO CONFIRM THE APPOINTMENT OF
4 MEMBERS OF THE INTERIM BOARD OF COMMISSIONERS OF
5 THE REGIONAL WATER AUTHORITY OF CENTRAL
6 ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, the Consolidation Agreement duly adopted by the Board of Directors of
9 the City of Little Rock, Arkansas, in Little Rock, Ark., Ordinance No. 18,410 (January 9,
10 2001), and by the City Council of North Little Rock, Arkansas, provides for the appointment
I1 of an Interim Board of Commissioners to assist in seeking the enactment of the legislation
12 authorizing the interlocal agreement for regional water commissions and in addressing issues
13 of mutual concern, planning for the consolidation and the operation of the consolidated system,
14 and participating in the rate student and improvement agenda, and
15 WHEREAS, pursuant to the Consolidation Agreement, which has been approved by
16 the Office of the Attorney General pursuant to Ark. Code Ann. § 25 -20 -104 (Michie Repl.
17 1996), the Little Rock Water Commission has appointed four (4) members, namely, two (2)
18 current members of the Little Rock Water Commission and two (2) Little Rock residents who
19 have not served on the Little Rock Water Commission, and the North Little Rock Water
20 Commission is to appoint three (3) members, namely, two (2) current members of the North
21 Little Rock Water Commission and one (1) North Little Rock resident who has not served on
22 the North Little Rock Water Commission, and
23 WHEREAS, all members so appointed are subject to confirmation by the Little Rock
24 Board of Directors and the North Little Rock City Council, and
25 WHEREAS, the Little Rock Water Commission has now appointed the following
26 persons to serve on the Interim Board of Commissioners: M. Jane Dickey, Chair of the Little
27 Rock Water Commission; Craig S. Wood, Commissioner; Alma Minton Williams, Little Rock
28 resident; and, Thomas W. Rimmer, Little Rock resident; and
29 WHEREAS, the North Little Rock Water Commission has now appointed the following
30 persons to serve on the Interim Board of Commissioners: Francille Turbyfill, Chair of the North

1 Little Rock Water Commission; Claude B. Wilson, Commissioner; and, Eddie Powell, North
2 Little Rock resident; and,
3 WHEREAS, the Little Rock Water Commission and the North Little Rock Water
4 Commission have submitted these names to the Little Rock City Board of Directors and the
5 North Little Rock City Council for confirmation,
6 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
7 THE CITY OF LITTLE ROCK, ARKANSAS:
s Section 1. The Board of Directors confirms the appointment of the following persons
9 as the Little Rock representatives of the Interim Board of Commissioners of the Regional Water
10 Authority of Central Arkansas pursuant to the approved Consolidation Agreement now in effect
11 by and between the City of Little Rock, Arkansas, the Little Rock Water Commission, the City
12 of North Little Rock, Arkansas, and the North Little Rock Water Commission:
13 (A) M. Jane Dickey, Chair of the Little Rock Water Commission;
14 (B) Craig S. Wood, Member of the Little Rock Water Commission;
15 (C) Alma Minton Williams, Little Rock resident;
16 (D) Thomas W. Rimmer, Little Rock resident.
17 Section 2. Pursuant to the authority granted in Section 2.02 of the approved
18 interlocal Conhdation Agreement, the Board of Directors confirms the following persons as the
19 North Little Rock representatives of the Interim Board of Commissioners of the Regional
20 Water Authority of Central Arkansas:
21 (A) Francille Turbyfill, Chair of the North Little Rock Water Commission;
22 (B) Claude B. Wilson, Member of the North Little Rock Water
23 Commission;
24 (C) Eddie Powell, North Little Rock resident.
25 Section 3. The Mayor and the City Clerk are authorized and directed to take such
26 action as may be necessary or desirable to notify the Little Rock City Board of Directors, the
27 respective water commissions, and the persons so appointed, of their confirmation by the Board
28 of Directors, and to take such other action as may be necessary to permit the said appointees
29 to qualify as Interim Board Commissioners of the Regional Water Authority of Central
30 Arkansas.

Section 2. Severability. In the event any title, section, subsection, paragraph, item,
sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions of the
resolution which shall remain in full force and effect as if the portion so declared or adjudged
invalid or unconstitutional was not originally a part of the resolution.
Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that
are inconsistent with the provisions of this resolution are hereby repealed to the extent of such
inconsistency.
