HomeMy WebLinkAbout109360 0 1 RESOLUTION NO. 10,936 2 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 3 INTO A CONTRACT WITH GENESIS ENVIRONMENTAL 4 CONSULTANTS TO DO ENVIRONMENTAL SAMPLING AT THE CITY 5 LANDFILL; TO PERMIT THE CITY TO EXERCISE ONE -YEAR OPTIONS 6 TO EXTEND THE CONTRACT; AND FOR OTHER PURPOSES. 7 WHEREAS, the City operates a municipal landfill which is covered by various 8 state and federal environmental laws which, among other things, require periodic 9 groundwater sampling, and 10 WHEREAS, after a competitive process it was determined that Genesis 11 Environmental Consultants should be awarded a contract in an amount not to exceed 12 fifty -seven thousand eight hundred ($57,800.00) dollars, 13 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 14 THE CITY OF LITTLE ROCK, ARKANSAS: 15 Section 1. The City Manager is authorized to enter into an agreement, in a form 16 acceptable to the City Attorney, with Genesis Environmental Consultants to conduct 17 groundwater sampling at the City landfill in order to assure compliance with state and federal 18 environmental laws. 19 Section 2. This contract shall not exceed the amount of fifty seven thousand and eight 20 hundred ($57,800.00). Funds for this contract are available from the Solid Waste Services 21 budget in Account No. 603 - 220 - 2120 - 6081 -99. 22 Section 3. The City Manager is authorized to exercise one or more of the four one -year 23 options to renew this agreement for a one -year term that was referenced as part of the selection 24 process. The contract may authorize an automatic renewal each year for the four (4) years, 25 provided in any year in which the City Manager notifies the Board of Directors that funds may 26 not be available in Account No. 603 - 220 - 2120 - 6081 -99 to pay the fee for such renewal, no 27 renewal shall be valid until approved by resolution of this Board. 28 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 29 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 30 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 5. Repealer. All laws, ordinances, resolutions, or. parts of the same, that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
