3 A RESOLUTION OF INTENT TO APPROVE CONTRACTS WITH SANDRA
4 MITCHELL AT 1620 CUMBERLAND, AND WITH CRAIG HILLER AT
5 311 EAST FOURTEENTH STREET, AS PART OF THE TORNADO AREA
6 DISASTER REBUILD TARGETED NEIGHBORHOOD ENHANCEMENT
7 PLAN; AND FOR OTHER PURPOSES.

9 WHEREAS, the City Board of Directors authorized consideration of a
10 Targeted Neighborhood Enhancement Plan ( "TNEP ") in the area that was devastated
II by the January tornadoes and, to that end adopted Little Rock, Ark., Resolution No.
12 10,634 (September 7, 2000), and
13 WHEREAS, after the review procedures set forth in Act 320 of 1997, as
14 amended, the Board concluded that it will create the Tornado Area Disaster Rebuild
15 TNEP and, on this same date, passed an ordinance to formalize this decision, and
16 WHEREAS, under Arkansas law. this resolution will not be final until the 30-
17 day referendum period expires as set forth in Amendment 7 to the Arkansas
18 Constitution, and appropriate Arkansas statutes' and City ordinances, and
19 WHEREAS, the City has received appropriate applications to contract with the
20 City for TNEP funds once the referendum period expires, appropriate contracts --
21 acceptable to the City Attorney -- have been executed, and the contracts have been filed
22 of record, and would like to state its intent to enter into these agreements,
23 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
24 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
25 Section 1. The City Manager is authorized to enter into agreements with the
26 following persons pursuant to Act 320 of 1997 as amended, provided the contracts are
27 properly executed and filed of record as approved by the City Attorney and, provided
28 further, that the 30 -day referendum period of this resolution has expired:

1 (A) Sandra Mitchell, who agrees to live as an owner - resident of
2 the residential dwelling at 1620 Cumberland, Little Rock, Arkansas,
3 in an amount not to exceed twenty-nine thousand, four hundred
4 and nienty-four and no /100's ($29,494.00) dollars; and
5 (B) Craig Hiller, who agrees to live as an owner- resident of the
6 residential dwelling at 311 East Fourteenth Street, Little Rock,
7 Arkansas, in an amount not to exceed twenty thousand and four
s hundred and no /100's ($20,400.00) dollars.
9 Section 2. Severability. In the event any title, section, subsection, paragraph,
10 item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be
11 invalid or unconstitutional, such declaration or adjudication shall not affect the
12 remaining portions of the resolution which shall remain in full force and effect as if the
13 portion so declared or adjudged invalid or unconstitutional was not originally a part of
14 the resolution.
15 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same,
16 that are. inconsistent with the provisions of this.resolution are hereby repealed to the
17 extent of such inconsistency.
