RESOLUTION NO. 10.914
3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 ESTABLISH AN ENTERPRISE FUND FOR RECEIPTS FROM THE
5 LICENSURE OF ANIMALS WITHIN THE CrrY OF LITTLE ROCK,
6 AND FROM INCREASED FINES FOR THE OWNERS OF IN TACT
7 ANIMALS RUNNING AT LARGE; AND FOR OTHER PURPOSES.

9 WHEREAS, on September 19, 2000, the Board of Directors passed a new license
10 scheme for dogs and cats living and maintained within the corporate limits of the City,
11 and
12 WHEREAS, an aspect of this scheme was a tiered approach to licensure which
13 required neutered animals to pay $7.50 for an annual license, and in tact animals to pay
14 $30.00 for such a license, and further to established a tiered approach to fines for
15 animals running loose within the City so that the owners of in tact animals would pay
16 a higher fine because of the possibility the animal, while loose, might procreate and add
17 to the animal population problem within the City, and
18 WHEREAS, the purpose for this tiered approach was to help decrease the
19 number unwanted, unlicensed, uncared for animals within the City which, eventually,
20 are taken into custody by the Animal Services Division and euthanized, and
21 WHEREAS, the additional license fees and fines are to be dedicated to the
22 operation and maintenance of the Animal Services Division, and to the payment of
23 programs to encourage owners to have their pets neutered and, in appropriate situations,
24 to contact with veterinarians to perform this service for Little Rock citizens at a reduced
25 rate, and
26 WHEREAS, an enterprise fund type may be used to account for such operations
27 where the intent is that the costs of providing these particular services to the general
28 public on a continuing basis are financed and recovered primarily through these
29 additional fees and fines,
I NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
2 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
3 Section 1. The City Manager is authorized to establish an enterprise fund for
4 the Animal Services Division that consists of the license fees charged annual for pets
5 licensed within the corporate limits of the City of Little Rock, and of fines assessed to
6 pet owners who permit their animals to illegally run at large within the City.
7 Section 2. Severability. In the event any title section, paragraph, item, sentence,
8 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
9 unconstitutional, such declaration or adjudication shall not affect the remaining portions
10 of the resolution which shall remain in full force and effect as if the portion so declared
11 or adjudged invalid or unconstitutional was not originally a part of the resolution.
12 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that
13 are inconsistent with the provisions of this resolution are hereby repealed to the extent
14 of such inconsistency.

During the recent discussion about a tiered approach to licenses and fines assessed for
animals maintained within the City, a suggestion was made that any increase in revenues
should be dedicated to the Animal Services Division. Specifically, the City was encouraged
to adopt a program to assist families with the cost of the operation to spay or neuter a pet.
The Task Force that proposed the ordinance made this recommendation, and information
was provided to the Board from successful programs in North Little Rock, as well as in other
cities across the country. Director Adcock pointed out that the veterinarians who
commented about the City's ordinance also insisted that such a program should be put into
place.
The Board has been informed that a mere grant to a family to decrease or eliminate
the cost of such an operation is prohibited by the Arkansas Constitution. However, it would
be possible to contract with various veterinarians to perform a service to decrease the size of
the unwanted animal population. The fact that certain families meeting qualifications set by
the City would benefit from this program does not necessarily defeat the public purpose of
the program, particularly if it is carefully set up and appropriate and strict guidelines are set
and followed.
To that end, funding for such contracts, and for additional Animal Services Division
expenses, is necessary. The attached resolution permits the creation of an enterprise fund to
capture in a specific account, dedicated to animal services, any increase in license fee
revenues for in tact animals, and any additional fine revenues for animals running at large.
The Board had discussed taking this action as a part of the budget process. Director
Adcock, as I understand it at the request of the veterinarians and the Task Force, asked that
I specifically draft this resolution.
