HomeMy WebLinkAbout10883I 10OLUTION NO. 10,883 2 3 A RESOLUTION APPROVING THE EXTENSION OF 4 SEWER SERVICE TO 120 ACRES LOCATED ON THE 5 WEST SIDE OF SOUTH KATILLIUS ROAD AT 6 FOREST LANE, OUTSIDE THE CITY LIMITS; AND 7 FOR OTHER PURPOSES. 8 WHEREAS, the Little Rock Board of Directors has received a request from the 9 applicant to approve the extension of sewer service to an approximate 120 acre tract of 10 land which is referred to as Island "J" in Little Rock, Ark., Ordinance No. 18,155 11 (December 7, 1999), and 12 WHEREAS, Island "J" was one of the 11 islands of land included in the ordinance 13 annexing said islands which is now subject to appeal in the case of Chandler, et al. v. City 14 of Little Rock, Pulaski County Chancery Court, Fourth Division, No. OT 99 -6497, and 15 WHEREAS, part of Island "J" has been approved by the Little Rock Planning 16 Commission for development in Valley Falls Estates preliminary plat and it is necessary that 17 said development receive sewer service from the City prior to commencement of the 18 development, and 19 WHEREAS, the attorney for the plaintiff in the above - styled case has no objection 20 to the City's extension of sewer service to this development, and 21 WHEREAS, the application meets the requirements of City policy on the extension 22 of sewer service outside the City, and 23 WHEREAS, the staff at the. Little Rock Waste Water Utility has reviewed and 24 approved the extension subject to the approval by the Little Rock Board of Directors, and 25 WHEREAS, the developer will pay all costs of the extension of the sewer service into 26 the proposed development, and 27 WHEREAS, the developer will execute a pre- annexation agreement with the City. 28 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS 29 OF THE CITY OF LITTLE ROCK, ARKANSAS: I Section 1. The Ord of Directors hereby approve e0sion of a sewer main to serve 2 an approximate 120 acre tract of land located on the west side of South Katillius Road at 3 Forest Lane which is adjacent to the Little Rock city limits, and more particularly described 4 in Exhibit "A" attached to this ordinance and made a part hereof.
