3 A RESOLUTION TO AUTHORIZE A LEASE AGREEMENT
4 BETWEEN THE CITY AND UAMS ECCO HEAD START TO
5 PROVIDE CHILD CARE SERVICES AT THE NATHANIEL
6 HILL COMMUNITY COMPLEX; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, the City has operated a child care facility at the Nathaniel Hill Community
10 Complex for many years, and in the last several years has included this operation as a part of
11 the Department of Parks & Recreation, and
12 WHEREAS, various financial constraints have led to the suggestion that the City lease
13 the property and facilities to a private provider, and
14 WHEREAS, a competitive selection process was instigated which focused upon the
15 provider's willingness and ability to provide a quality program for youth within the area of the
16 Nathaniel Hill Community Complex, the commitment to maintain the program at this
17 particular site for a significant period of time, the agreement to work with existing employees
18 to accept similar positions with the new child care provider, and the demonstration of an
19 excellent program that can meet all necessary regulatory guidelines, -and
20 WHEREAS, the four organizations that responded with proposals were Reverend
21 Homer Fairchild with the Greater New Freedom Child Care Academy, Lil Scholars Day Care
22 Centers, Tru -Care Child Development Center, and the University of Arkansas for Medical
23 Sciences Head Start Child Development Program (DAMS ECCO Head Start), and
24 WHEREAS, after careful consideration the Board of Directors accepts the review
25 committee's recommendation to lease to a provider whose application and program meet the
26 City's interests and assures continuation of a quality child care program at this site,
27 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
28 THE CITY OF LITTLE ROCK, ARKANSAS:
29 Section 1. The City Manager is authorized to enter into a lease agreement with
30 University of Arkansas for Medical Sciences ECCO Head Start, in a form acceptable to the City

1 Attorney, for the lease of certain facilities at the Nathaniel Hill Community Complex at 2500
2 East Sixth Street, Little Rock, Arkansas, to be used to provide a child care program to children
3 in the area for a period of not less than seven (7) nor more than twenty (20) years; further, this
4 lease agreement may permit certain modifications or amendments by agreement of the City
5 Manager, provided that no amendment which limits or negatively impacts or substantially alters
6 the scope of child care services to be offered will be approved without prior notice to the Board
7 of Directors unless such amendment in required by state or federal law and the City's ability to
8 object is preempted as a matter of law.
9 Section 2. Severability. In the event any title, section, subdivision, paragraph,
10 subparagraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged
11 to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining
12 portions of the resolution which shall remain in full force and effect as if the portion so declared
13 or adjudged invalid or unconstitutional was not originally a part of the resolution.
14 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
15 inconsistent with the provisions of this resolution are hereby repealed to the extent of such
16 inconsistency.
