HomeMy WebLinkAbout108601 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 0 0 RESOLUTION NO. 10,860 A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE AN AMENDMENT TO THE BILL OF ASSURANCE OF THE LITTLE ROCK PORT INDUSTRIAL PARK TO PROVIDE FOR AN INCREASE OF BUILDING COVERAGE FROM FORTY PERCENT (40 %) TO FIFTY PERCENT (50 %) OF THE LOT; AND FOR OTHER PURPOSES. WHEREAS, the Board of Commissioners of the Little Rock Port Authority have voted to amend its Bill of Assurance to increase the lot area of coverage of structures within the Port from forty percent (40 %) to fifty percent (50 %); and WHEREAS, the Little Rock Board of Directors finds that such amendment of the Bill of Assurance is appropriate for the Port to allow buildings to cover a larger portion of the lots within the Port. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: The Mayor and City Clerk are authorized to execute an Amendment of Bill of Assurance of the Little Rock Port Industrial Park to allow for an increase in lot coverage of structures from forty percent (40 %) to fifty percent (50 %), in substantially the form of the Amendment of Bill of Assurance attached hereto as Exhibit "A" subject to the approval of the City Attorney. Carpenter, City Aj orney APPROVED: Jim Lailey, Mayor 0 LITTLE ROCK PORT INDUSTRIAL PARK AMENDMENT OF BILL OF ASSURANCE WHEREAS, the City of Little Rock, Arkansas, a municipal corporation (the "City ") is the owner of more than fifty -one percent (51 %) of the area of land within the Little Rock Port Industrial Park (the "Port') described in that certain original Bill of Assurance dated December 16, 1971, and recorded December 16, 1971 in the records of the Circuit Clerk and Ex- officio Recorder of Pulaski County, Arkansas, in Record Book 1175 at page 543 (the "Bill of Assurance ") as subsequently amended and as amended herein; and WHEREAS, paragraph 10 of the Bill of Assurance entitled "Size of Buildings" provides that no structure within the Port shall cover more than forty percent (40 %) of the total land area of the lot on which it is located; and WHEREAS, the City deems it necessary to amend the provision to allow structures to cover not more than fifty percent (50 %) of the total land area within the lot on which the structure is located; and WHEREAS, the undersigned being the owners of at least fifty -one percent (51 %) of the area of the land within the Port as described in the Bill of Assurance have the authority to make this Amendment. NOW, THEREFORE, WITNESS: 1. That paragraph 10 entitled "Size of Buildings" of the Bill of Assurance is hereby deleted in its entirety, and the following language shall be substituted therefore: 10. Size of Buildings. No building or other structure shall be constructed or maintained which covers more than fifty percent (50 %) of the total land area within the lot on which the structure is located. EXHIBIT 0 0 2. Except as amended hereby, all the remaining provisions of the Bill of Assurance are valid and in full force and effect. WITNESS our hands and seal this day of 2000.
