A RESOLUTION AUTHORIZING THE PAYMENT OF $185,000 IN 210
ATTORNEYS FEES IN THE CASE OF COATES V. LITTLE
ROCK; CONTINGENT UPON REVIEW BY THE CITY
ATTORNEY AND THE COURT'S APPROVAL OF THE CLASS
ACTION SETTLEMENT; AND FOR OTHER PURPOSES.
WHEREAS, the parties have reached an amicable settlement in Coates. v. Little Rock,No.
LR -C -95 -302 (U.S.D.C.), an Americans with Disabilities Act Class Action lawsuit against the City;
and
WHEREAS, the City agi-eed to pay $185,000 to the Plaintiffs' attorneys as part of the
settlement; and
WHEREAS, the time period for class members to object to the settlement has passed and
no objections were filed in Federal Court; and
WHEREAS, the City Manager is authorized to pay such attorney's fees contingent upon
review by the City Attorney and the Court's approval of the settlement, on or about May 21, 1999,
the date of the fairness hearing in Federal Court.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
"SECTION 1. The City Manager is authorized to pay $185,000 in attorney's fees to
Plaintiffs attorney of record, Luther Sutter, contingent upon review by the City Attorney and the
Court's approval of the settlement in Coates v. Little Rock, on or about May 21, 1999.
