3 A RESOLUTION REVOKING FRANCHISES IN PORTIONS OF
4 MCLEAN AND EAST THIRD STREETS PREVIOUSLY
5 GRANTED BY THE CITY TO BUSINESSES OPERATING IN
6 THE FORMER CHOCTAW RAILROAD STATION BUILDING.

8 WHEREAS, by Little Rock Resolution ( "LRR ") No. 8,269 (February 28, 1990), the
9 Little Rock Board of Directors granted a franchise to Spaghetti Warehouse, Inc. for use of a
10 portion of McClean and East Third Streets for renovation of the former Choctaw Railroad
I 1 Station, and for parking, landscaping and fencing as was required for the development; and
12 WHEREAS, LRR No. 8,341 (August 7, 1990) amended LRR No. 8,269 concerning
13 the parking agreement between the City and the grantee of the franchise; and
14 WHEREAS, Spaghetti Warehouse, Inc. subsequently conveyed the building and
15 grounds to Dennis and Danny Martindill and the City granted the same franchise to the current
16 owners for uses and purposes stated therein by LRR No. 9,657 (April 2, 1996); and
17 WHEREAS, the right -of -way granted by the franchises in LRR No. 8,269, LRR No. 8,341
18 and LRR No. 9,657 is within the area planned for the Clinton Presidential Library District and
19 is now needed by the City for development of the library and grounds.
20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
21 OF THE CITY OF LITTLE ROCK, ARKANSAS:
22 SECTION 1: The City hereby revokes the franchises within the right -of -way described
23 in LRR No. 8,269, LRR No. 8,341 and LRR No. 9,657.
24 SECTION 2. The owners of The Edge nightclub are granted a license agreement in
25 a form acceptable to the City Attorney to use the previously franchised area until the license is
26 revoked.
27 SECTION 3. The franchises revoked by this resolution are more particularly described
28 as follows:
29 Part of McLean Street , more particularly described as: Beginning at the NE
30 Corner of Block 9, Russell's Addition, thence S 88° 34'E, along the north
31 line of said Block 9, extended 25.42 feet to a point which is 5.0 feet west of
32 the centerline of the railroad track; thence S 1 ° 24'W along a line which is
33 5.0 feet west of and parallel to said centerline of track 304.0 feet to a point
34 on the north R/W of East Third Street Extended; thence N 88 ° 34'W along
35 the north R/W of East Third Street Extended 18.0 feet to the SE Corner of
36 Block 3, Rectortown to the City of Little Rock, Arkansas, thence north

along the east line of said Block 3, Rectortown and the east line of Block 9,
Russell's Addition 304.1 feet to the point of beginning, containing 6600.93
square feet, more or less.
Part of East Third Street, more particularly described as: Parcel "A" -
Beginning at the SW Corner of Block 3 Rectortown to the City of Little
Rock, Arkansas; thence south along the east line of Byrd Street 13.5 feet;
thence S 88° 34'E parallel to and 13.5feet south of the north line of East
Third Street 300.0 feet to the east line of McLean Street; thence north 13.5
feet to the SE corner of said Block 3; thence N 88° 34'W along the north
line of East Third Street 300.0 feet to the point of beginning containing 4050
S.F., more or less.

Parcel `B" - Beginning at the SE Comer of Block 3, Rectortown to the City
of Little Rock, Arkansas; thence south along the west line of McLean Street
13.5 feet; thence S 880 34'E 17.67 feet; thence N 1 ° 24'E 13.5 feet; thence
N 880 34'W 18.0 feet to the point of beginning, containing 242.2 S.F., more
or less.
SECTION 4. This resolution shall remain in full force and effect from and after its
adoption and approval.
