4 A RESOLUTION AUTHORIZING THE CITY MANAGER

TO ENTER INTO AN AGREEMENT WITH THE
6
7 DEPARTMENT OF ENERGY (DOE) TO HELP
8 COMMUNITIES AND REGIONAL PARTNERSHIPS TO
9 IMPROVE ENERGY EFFICIENCY IN COMMERCIAL
10
11 AND MULTIFAMILY BUILDINGS.

13 WHEREAS, the Department of Energy (DOE) has established a REBUILD
14 AMERICA PARTNER program designed to improve energy efficiency in buildings that
15
16 reduces energy costs, increases available capital, spurs economic growth and improves
17 working and living environments; and
18 WHEREAS, the Department of Energy has invited the City of Little Rock ( "City")
19
to join its Rebuild America Partner Program and to use its best efforts to lead in the
20
21 development of a community partnership that may include mayors and other government
22 administrators; and
23 WHEREAS, the City believes that the aspirations of the Rebuild America Program
24
25 is worthy and benefits the community in which the goals of the Rebuild America Programs
26 are implemented; and
27 WHEREAS, the City intends to voluntarily undertake improvements of energy
28 efficiency systems which are in accordance with the aspirations of the Rebuild America
29
30 Program; and
31 WHEREAS, the City already has similar goals in constructing energy efficient
32 system improvements, enrollment in the Rebuild America Program as a partner with the
33 DOE will place no additional burden on the City; and

WHEREAS, the DOE has formally invited the City to become a partner in the
Rebuild America Program by executing an agreement to develop a multi year action plan
within one year of the date of the signed agreement to state specifically energy efficient
goals; and
WHEREAS, the City and DOE have acknowledged and agreed that any agreement
executed between them will not be a formal binding contract, but simply a document which
represents the mutual aspirations of the City and the DOE concerning improving the
environment; and
WHEREAS, it is desirable and in the best interest of the City to formally become a
partner in the DOE Rebuild America Program and to execute an agreement with DOE; and
WHEREAS, DOE provides partnerships with technical and financial assistance to
help them plan and carry out energy efficient retrofits.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Manager is authorized to enter into a Rebuild America
Partnership with the United States Department of Energy for the purpose of improving
commercial and multifamily building energy efficiency.
SECTION 2. The City Manager is authorized, on behalf of the City, to execute,
accept or deliver any further documents as he may deem desirable and appropriate to
consummate the transaction authorized by this resolution.
SECTION 3. The Rebuild America Partnership Agreement will not become effective
until it has been executed by the City Manager, attested to by the Municipal Clerk and
delivered to DOE.
SECTION 4. That any agreement executed between the City and the DOE will not
be a formal binding contract, and will impose no liability upon the City, but will simply be
a document which represents the mutual aspirations of the City and the DOE concerning
improving energy efficiency of commercial and multifamily buildings.
