A RESOLUTION TO DIRECT THAT THE
MONIES COLLECTED FROM LICENSE
FEES, OR FINES, FROM ORDINANCES
THAT DEAL WITH THE SELL OF
TOBACCO PRODUCTS TO MINORS BE
USED FOR ENFORCEMENT AND
EDUCATION PROGRAMS; AND FOR
OTHER PURPOSES.

WHEREAS, the Mayor announced in his 1997 State of the City address a desire to
develop a meaningful program designed to stop the ability of minors within the City to obtain
tobacco products, and
WHEREAS, after several discussions and public meetings, two ordinances have been put
forth that create a special occupation tax for businesses that sell tobacco products, and which set
forth penalties for businesses or individuals that make it possible for minors to obtain tobacco
products, and
WHEREAS, it is readily apparent that the effectiveness of these programs is dependent
upon education of youth to avoid these products, and upon enforcement actions by the City to
assure that these products are not used by youth, and
WHEREAS, it is only natural that any revenues generated by these ordinances should be
used to finance these programs and enforcement efforts,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Manager is directed to assure that any monies generated
from businesses that obtain a license to sell tobacco products to adults shall be segregated from
the City budget and shall be used solely to assist in the cost of enforcement efforts to assure
compliance with City ordinances designed to prevent the sell of tobacco products to minors.

SECTION 2. •The City Manager is directed to ass•that any monies generated
from fine revenues in municipal court, exclusive of the payment of court costs, for the violation
of City ordinances that prohibit the sell of tobacco products to minors, shall be segregated in the 341
City budget and shall be used to pay the cost of education or cessation programs, or community
service programs, designed to assure that youth will not use tobacco products.
SECTION 3. If more funds that necessary to handle enforcement or education
and training efforts are generated in any given fiscal year, these funds may be used for other City
purposes if, and only if, the City Manager provides information to the Board of Directors about
the excess funds available, and the Board of Directors, by resolution, authorizes the City
Manager to use these funds for other City purposes.
