HomeMy WebLinkAbout99601 1$6 2 3 RESOLUTION NO. 99,960 4 5 6 A RESOLUTION EXPRESSING THE WILLINGNESS OF 7 THE CITY OF LITTLE ROCK, ARKANSAS, TO ALLOW A 8 NEW RESIDENTIAL SUBDIVISION TITLED BERTA' 9 REPLAT LOCATED AT THE NORTHEAST CORNER OF 10 ASBURY ROAD AND KANIS ROAD ACCESS TO KANIS 11 12 ROAD. 13 14 WHEREAS, the Berta Replat was approved by the Little Rock Planning Commission on 15 October 10, 1996, with the approval of the consent agenda, and 16 WHEREAS, the applicant agreed with the staff request to limit access to the new lot being 17 18 created from Kanis Road, a minor arterial which is currently planned to be a divided arterial; and 19 WHEREAS, the Board of Directors with a positive recommendation from the Planning 20 Commission and a recommendation of approval from staff, conditioned on the limit of new 21 residential access from Kanis Road, approved a conditional waiver of boundary street improvements 22 with the passage of Little Rock, Ark., Ordinance No. 17,298 (November 7, 1996); and 23 WHEREAS, the applicant subsequently found that the cost to install a drive from Asbury 24 25 Road, a residential side street, as represented by an access easement located on the northern twenty 26 foot strip of Lot 2 compared with the cost of constructing a drive from Kanis Road was unacceptable. 27 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 28 THE CITY OF LITTLE ROCK, ARKANSAS: 29 SECTION 1. The City Board of Directors will permit the filing of the final plat of Berta 30 31 Replat without the access easement across Lot 2 providing access to Asbury Road for Lot 1 and 32 without a no vehicular access easement located adjacent to Kanis Road. 33 SECTION 2.
