A RESOLUTION TO AUTHORIZE SETTLElMM OF
VARIOUS CLAWS IN LITIGATION CONCERNING
K1L4MER SCHOOL; TO AUTHORIZE THE CONVEYANCE
TO HISTORIC INVESTIMTS SOLUTIONS TRAM; AND
FOR OTHER PURPOSES.
WHEREAS, the City of Little Rock, Arkansas, has been
involved in various forms of litigation with Hampton Roy and
Michelle Roy concerning the condemnation and the City's refusal
to permit the demolition of Kramer School; and
WHEREAS, the City condemned the school for the purpose of
allowing this historic structure to be preserved and
rehabilitated; and
WHEREAS, the City has an opportunity to participate in a
plan to rehabilitate this structure and to settle all
outstanding litigation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The Mayor, the City Manager and the City Clerk
are authorized to execute a settlement agreement with Hampton
and Michelle Roy to settle all outstanding litigation concerning
Kramer School, provided that such settlement be in a form
acceptable to the City Attorney and that the ultimate additional
payment from the City not exceed the sum of forty -five thousand
dollars ($ 45,000) from Account No. 210- 040 -0370.
Section 2. The Mayor and the City Clerk are authorized to
execute a deed in the form acceptable to the City Attorney to
convey the property upon condition that the rehabilitation
project commence on or before a date specified in the agreement,
and if project is not commenced by such date that title revert
to the City, that the City will be held harmless from any
environmental liability caused by the need to remove asbestos
from the property.
Section 3. If the project commences within the time
specified, the City shall be held harmless from any
environmental liability caused by the need to remove asbestos
from the property.
