WHEREAS, the City Manager announced that as a result of the Arkansas Supreme Court's opinion in Foster v. Jefferson County uorum Court, which negatively impacted the collection of countywide sales and use taxes, it was necessary to declare a freeze on hiring and spending; and WHEREAS, the Arkansas Supreme Court, in response to a petition for rehearing, including an amicus curiae filing by the Little Rock City Attorney's office, has now ruled that countywide sales and use taxes are authorized by the Arkansas Constitution; and WHEREAS, the City Manager and the City Attorney believe that the possibility of a third reversal is remote. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: The Board of Directors endorses the decision of the City Manager to set aside the freeze on hiring and spending that was imposed as a result of the first decision of the Arkansas Supreme Court in Foster v.
