JEFFERSON COUNTY QUORUM COURT 7 BEFORE THE ARKANSAS SUPREME COURT TO 8 URGE THAT THE COURT REHEAR THE CASE 9 AND MODIFY ITS OPINION TO NOTE THAT 10 COUNTYWIDE SALES AND COMPENSATING 11 USE TAXES ARE CONSTITUTIONAL, AND 12 FOR OTHER PURPOSES. 13 14 WHEREAS, the Arkansas Supreme Court has recently issued an 5 15 opinion that holds that countywide sales and compensating use taxes, particularly taxes that exceed one -half of one percent 17 and used for general purposes, are not authorized under Article 18 16 of the Arkansas Constitution; and 19 WHEREAS, the City of Little Rock has been party to several 20 in which such taxes have been deemed state taxes adopted 21 cases pursuant to Article II of the Arkansas Constitution and, as 22 such, as not subject to the restriction of Article 16; an 23 WHEREAS, it is important that the Court consider this issue 24 it was not addressed in any of the opinions issued in the 25 since it is important that the Court consider the Foster case, and 26 impact of this decision in general. 27 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS O 28 THE CITY OF LITTLE ROCK, ARKANSAS: 29 SECTION 1. The City Attorney is directed to prepare 30 appropriate motions and briefs to tender and, if permitted, to 31 file as amicus curiae in Foster v.
