A RESOLUTION AUTHORIZING
OF LITTLE ROCK TO PLACE
RESTRICTION IN TITLE TO
TO COMPLY WITH FEDERAL
CLOSURE REGULATIONS;
OTHER PURPOSES.

AND FOR
WHEREAS, in 1977, the City of Little Rock ("City°) acquired
a 130 acre tract of land from Ouachita Baptist University for
One Hundred Thirty Thousand Dollars ($130,000); and
WHEREAS, the property was developed and used by the City as
a municipal landfill; and
WHEREAS, the property is no longer needed for landfill
purposes and it is now subject to federal regulations concerning
closure procedures; and
WHEREAS, federal closure requirements mandate that the City
place a restriction in its title to the property such that no
residential buildings or structures shall be erected upon the
land.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City owned and operated a landfill on the
following described real property located at 11,400 Ironton
Cutoff Road in Pulaski County, Arkansas:
The Northeast Quarter (NE 1 /f) of the Northwest
Quarter (NW 1/4) of Section 16;
All of the Southeast Quarter (SE 1/4) of the Southwest
Quarter (SW 1/4) of Section 9, the Southwest Quarter
(SW 1/4) of the Southeast Quarter (SE 1/4) of Section
9, and the Northwest Quarter (NW 1/4) of the Northeast
Quarter (NE 1 /4) of Section 16, lying West of Ironton
Cutoff Road and containing 130 acres, more or less,
all in Township 1 South, Range 12 West, Pulaski
County, Arkansas.

SECTION 2. The following language shall be placed in any
deed or conveyance of the property described in Section 1 of the
Resolution, to comply with federal and state landfill closure
requirements:
This property has been permitted as a landfill under
the Arkansas Solid Waste Management Act and under Act
178 of the 1993 Arkansas General Assembly. It is
unlawful for any person, partnership, company,
corporation or other entity to build, erect, or
construct any house, home, or building to be used for
residential purposes on this property.
SECTION 3. This resolution shall be filed in the deed
records of the Pulaski County Circuit Clerk and in the office of
the City Clerk to provide notice of the limitation of title in
the property described in Section 1.
