HomeMy WebLinkAbout9326• 0 4G 1 2 RESOLUTION NO. 9,326 3 A RESOLUTION AUTHORIZING AN AGREEME T 4 BETWEEN THE CITY OF LITTLE ROCK, ARKANSAS 5 AND NORTH LITTLE ROCK, ARKANSAS TO ACCESS 6 THE CITY OF LITTLE ROCK'S 800 MHS TRUNKED 7 RADIO SYSTEM; TO UPGRADE LITTLE ROCK'S RS 6000 COMPUTER TO ALUM NORTH LITTLE ROCK TO 8 USE ITS MOBIL DATA CHANNEL; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS, the City of Little Rock owns and operates an 800 12 MHz trunked radio system which provides radio coverage for essentially all of Pulaski County and one Mobil Data Channel; 13 and 14 WHEREAS, the Little Rock 800 MHz trunked radio 15 communication system was designed to provide coverage for the 16 entire county; and 17 WHEREAS, North Little Rock is interested in joining the City's 800 MHz trunked radio communication system; and 18 WHEREAS, the addition of North Little Rock will require the 19 City of Little Rock to spend $31,000 to upgrade its RS 6000 20 computer; and 21 WHEREAS, public safety officials of both cities will 22 benefit by being able to communicate with each other; and WHEREAS, the City of Little Rock will receive revenues from 23 North Little Rock and future assistance in upgrading the City of 24 Little Rock's communication backbone. 25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS: 27 SECTION 1. W I T N E 8 8 E T H• WHEREAS, the City of Little Rock owns and operates an 800 MHz trunked radio system which provides radio coverage for essentially all of Pulaski County; and WHEREAS, the Little Rock 800 MHz trunked radio communications system was designed to provide coverage for the entire county; and WHEREAS, the City of North Little Rock is interested in joining the City's 800 MHz trunked radio communications system and operating a separate Mobil Data Channel; and WHEREAS, the addition of North Little Rock will have no negative impact on Little Rock operations; and WHEREAS, Public Safety Officials of both cities will benefit by being able to communicate with each other; and WHEREAS, the City of Little Rock will benefit by upgrading its RS 6000 computer and will receive revenues from North Little Rock and future assistance in upgrading the City of Little Rock's communication backbone. NOW THEREFORE, BE IT AGREED BY THE PARTIES AS FOLLOWS: ARTICLE I. TERM AND CONSIDERATION. Section 101. Term. The term of this Agreement is for one (1) year from 1995 to , 1996. It may be renewed annually upon agreement of the parties. M • �► 4,4 Section 102. Consideration. For and in consideration of the covenants set forth below, the City of North Little Rock agrees to pay a proportionate share, computed as the percent of North Little Rock's population compared to that of Pulaski County (349,660), of the annual maintenance fee of One Hundred Sixty -Nine Thousand Dollars ($169,000) paid annually. The percent share is based upon 1990 population data. North Little Rock's population is 17.66% of the entire county. Their proportionate share of the annual maintenance fee is currently $29,845. North Little Rock will pay its percent share of any increase in the annual maintenance fee. This payment is due when the Agreement is signed and upon the anniversary date of each subsequent renewal term. ARTICLE II. DEFINITIONS. Section 201. The following definitions apply to this Agreement: „Backbone° Communications system infra- structure, or fixed equipment, including but not limited to towers, computers, microwaves, and repeaters. Backbone does not include mobile radios, base stations, or dispatch equipment. 'Communications Point The Managers of the Office of of Contact"' Emergency Services in Little Rock and North Little Rock. °Dispatch Authority Several talk groups allocated to Group" one governmental entity, or departments of a governmental entity, and managed by the Systems Administrator. -2- M 50 "Dispatch Terminal" Motorola computer used to manage, enable, and disable talk groups. Dispatch terminals are located in Little Rock and North Little Rock. "SIMS 11 System° The Motorola computer and software that runs the 20 channel trunk radio system located in the Little Rock Office of Emergency Services. "Systems Administrator" A Little Rock Office of Emergency Services employee who manages the system. "Talk Group" Similar to or functions as a radio channel. An individual user will have talk groups assigned based upon job duties or needs. "User" Any person with a radio who uses the system. ARTICLE III. DUTIES. Section 301. Duties of the City of Little Rock. A. Talk Group Assignment and Management The City of Little Rock agrees to assign fifty -six (56) Talk Groups for use with the 800 MHz trunked radio system, to the City of North Little to operate independently, using a separate dispatch terminal with no interference from the City of Little Rock Communications Center. The City of North Little Rock agrees that the cost of an additional data channel will be their responsibility. The City of Little Rock agrees that the upgrade in their present computer network (RS 6000) will be absorbed by them. This will allow North Little Rock to run its data channel through Little Rock's RS 6000. The Managers of the Office of Emergency Services for their respective cities will serve as their cities' communications point of contact to discuss day -to -day operations. -3- 0 0 B. System Administration The City of Little Rock agrees to appoint a Systems Administrator to manage the day -to -day functions of the SIMS II System. The Systems Administrator will be responsible for the following: (1) Develop Dispatcher Authority Groups for customers who will maintain a dispatch terminal; (2) Upon receipt of the radio installation/pro- gramming worksheet from the North Little Rock authorized agent, the Administrator will add or change the appropriate radio record in the SIMS II Management Terminal, activate the radio for usage, update the SIMS II tracking system, and return the worksheet to the customer for the appropriate action. (3) Administer all Systems Manager Terminal functions such as maintaining user access control records, enabling phone internet capabilities, and providing system reports to the customer; (4) The Administrator will normally be available 24 -hours a day, 7 days a week to provide troubleshooting assistance. C. Communications Management Meetings The City of Little Rock agrees to schedule a quarterly communications management meeting during year one (1) of this Agreement and on an annual basis in subsequent years, for the purpose of discussing the operations of the communications system with North Little Rock's contact person. Section 302. Duties of North Little Rock. A. Talk Groups North Little Rock is responsible for requesting, in writing, the establishment, deletion, or change of Talk Groups. This will be forwarded to the Systems Administrator for action. A list of standard reports required will also be -4- provided to the Systems Administrator. Special reports must be done upon at least ten days' notice. Emergency situations requiring specific reports will be handled on a case -by -case basis. B. Maintenance of Equipment and Infrastructure North Little Rock agrees to be responsible for the procurement and maintenance of all radios, base stations, and dispatch equipment peculiar to North Little Rock's radio system. When North Little Rock wishes to add or change a radio, an authorized agent (designated in writing) will complete the appropriate sections (call number, user number, department, property tag, vehicle information, talk groups and special features requested, etc.) of the radio installation /programming worksheet. The worksheet will then be faxed or taken to the System Administrator for assignment of a Raw Radio ID (RRID) and entry into the SIMS II system. When the worksheet is returned, North Little Rock will contact the Motorola Workshop and set up an appointment for the installation /change. If North Little Rock purchases a dispatch terminal, North Little Rock will be responsible for performing dynamic regrouping, selective inhibits, and emergency alarm management. C. Problem Correction North Little Rock may contact Motorola technicians at 372 -5235 or the Systems Administrator at 371 -4540 if the dispatcher terminal /CAD interface experiences problems that cannot be resolved at the local level. If a problem occurs during non - office hours, the City of Little Rock's Communications center will be notified so that the Systems -5- • 52 provided to the Systems Administrator. Special reports must be done upon at least ten days' notice. Emergency situations requiring specific reports will be handled on a case -by -case basis. B. North Little Rock will take actions as requested by Motorola technicians or the Systems Administrator to help resolve the problem. D. Future Upgrades and Replacement Costs North Little Rock agrees that if new facilities or Backbone, are needed, above and beyond the current Little Rock system, they will be funded prorata by the City of North Little Rock. North Little Rock agrees to share proportionately in the future, necessary upgrades or replacement costs for the overall system Backbone. Additionally, if new facilities or Backbone are needed to support North Little Rock in the future, North Little Rock agrees to fund the additional items. E. Day -to -Day Operations North Little Rock agrees to name a single communications point of contact to discuss day -to -day operations with the City of Little Rock communications point of contact. 303. Compliance With Applicable Law and This Agreement. The City of Little Rock will not interrupt or interfere with North Little Rock communications, unless terms or conditions of this Agreement, or FCC rules and procedures are not followed by North Little Rock. North Little Rock agrees to abide by all applicable state and federal laws governing use of the 800 MHz trunked system. 304. Warranties. All warranties for the system are between the individual cities and Motorola, Inc. The City of Little Rock by this Agreement makes no warranty of the 800 MHz trunked system to the City of North Little Rock. The City of North Little Rock -6- 53 mom MM M M M M M M 54 acknowledges that the City of Little Rock has made no warranties of the 800 MHz trunked system. North Little Rock hereby waives all causes of action against the City of Little Rock for claims, losses, and damages and attorney's fees incurred as a result of utilizing the City of Little Rock's 800 MHz trunked system. ARTICLE IV. CONTACT PERSONS. Section 401. Contact Person for the City of Little Rock. Ron Gatewood, Manager, Office of Emergency Services, 720 West Markham, Little Rock, Arkansas 72201 (371- 4540). Section 402. Contact Person for North Little Rock. Lee Shaw, Manager, Office of Emergency Services, North Little Rock, 1206 Sycamore, North Little Rock, Arkansas 72114 (376- 8432). ARTICLE V. MISCELLANEOUS. Section 5.01. Agreement Covered by the Laws of Arkansas. This Agreement is covered by the laws of the state of Arkansas. Section 5.02. Non - appropriation. In the event North Little Rock fails to appropriate funds or sufficient funds for payments due under this agreement, North Little Rock shall promptly notify Little Rock in writing of such occurrence and this agreement shall terminate on the last day of the fiscal period for which appropriations were received. Little Rock's damages in the event of non - appropriation shall be limited to the actual expenses of deinstallation. -7- r r� �r ■r � r ri 0 Section 5.03. Severability. If any section or provision of this agreement is held invalid, such invalidity shall not affect other sections or provisions of the agreement, and to this end the sections or provisions of this agreement are declared severable. Section 5.04. Teralzation. This Agreement may be terminated by either party upon 30 days' written notice to the contact person listed above.
