HomeMy WebLinkAbout9035• • RESOLUTION NO. 9,035 A RESOLUTION AUTHORIZING THE CONVEYANCE OF EXCESS STREET RIGHT -OF -WAY TO FIRST COMMERCIAL BANK; AND FOR OTHER PURPOSES. 520 WHEREAS, First Commercial Bank, N.A. (the "bank") proposes to construct a branch bank facility at the southwest corner of Wright Avenue and Chester Street; and WHEREAS, a portion of platted right -of -way of Wright Avenue and 17th Street adjacent to the proposed bank has not been used or constructed for street purposes, and has been closed by ordinance of the Board of Directors; and WHEREAS, said portion of excess right -of -way is needed by First Commercial Bank for its use as a branch bank facility at this location; and WHEREAS, the Board of Directors has determined that the portion of closed right -of -way vested in the City is in excess of current and future requirements for street right -of -way purposes; and WHEREAS, the Board determines that said excess right -of -way may be conveyed to the bank upon consideration of the bank's payment of the fair market value of the right -of -way. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Mayor and the City Clerk are hereby authorized to execute a Warranty Deed of the excess right -of -way described in the deed attached hereto as Exhibit "A ", to First Commercial Bank, N.A., in consideration of the bank's payment to the City of the amount of $2,000 for the land. ADOPTED: November 2, 1993 • t ;ID JR =0M E0r,� • • M M M M M M M 11 � X21 WARRANTY DEED KNOW ALL MEN BY THESE PRESENTS: That the CITY OF LITTLE ROCK, an Arkansas municipal corporation, GRANTOR, by its Mayor, duly authorized by proper resolution of the Board of Directors, for and in consideration of the sum of Two Thousand Dollars ($2,000) and other valuable consideration, the receipt of which is hereby acknowledged, does hereby grant, bargain, sell and convey unto First Commercial Bank, N.A., an Arkansas Corporation, GRANTEE, and unto its successors and assigns forever, the following described lands in the County of Pulaski and State of Arkansas, to wit: Part of Lots 9, 10, and 11, Block 274 Fulk's Subdivision of Centennial Addition to the City of Little Rock, and that portion of Wright Avenue adjacent to the North lot line of Lot 12 of Block 25, Wright's Addition, all in Pulaski County, Arkansas, more particularly described as follows: Commencing at the SE Corner of Block 274, Fulk's subdivision of Centennial Addition to the City of Little Rock, Arkansas, said corner lying on the north right -of -way of Wright Avenue and west right -of -way of Chester Street, said corner being also the true point of beginning; thence N 87 029110" W 100.41 feet along the old north right -of -wax of Wright Avenue to a point on the present right -of -way line of Wright Avenue Bypass; thence Northeasterly along said present right -of -way line, being the arc of a 1,123.37 foot radius curve concave to the Northwest and a central angle of 40 011123 ", having a chord bearing and distance of N 75 003112" E, 109.35 feet to a point, said point being also the intersection of the south right -of -way of the said present Wright Avenue Bypass and the west right -of -way of Chester Street; thence S 09 017120" W 33.04 feet along the west right -of -way of Chester Street to the true point of beginning; and also the north one -half of the old right -of -way of 17th Street lying north of Lot 12, Block 25, Wright's Addition and south of the present right -of -way of Wright Avenue Bypass; containing 4,344 square feet (0.10 acre), more or less. Basis for bearing and distance is a plat dated October 20, 1966, by Robert W. Threet, Arkansas Registered Professional Engineer 1189 and labeled R.O.W. Dedication, Wright Avenue By Pass. M 52? TO HAVE AND TO HOLD unto said Grantee, and unto its successors and assigns forever, with all the tenements, appurtenances and hereditaments thereunto belonging or in anywise appertaining. And Grantor hereby covenants with the said Grantee that it will forever warrant and defend title to said lands against any and all claims and encumbrances whatsoever.
