RESOLUTION NO. 8,910
A RESOLUTION GRANTING A FRANCHISE TO
ARKANSAS CHILDREN'S HOSPITAL TO USE
A PORTION OF THE RIGHT -OF -WAY UNDER
BATTERY STREET FOR A PEDESTRIAN
TUNNEL AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. A franchise is hereby granted to Arkansas
Children's Hospital to use a part of the right -of -way under
Battery Street approximately one half block north of the
intersection of Battery and Maryland Avenue (West 9th Street)
for an underground pedestrian tunnel, provided the requirements
for approval are met prior to the franchise taking effect:
a. Proper plan review, permits and inspections for
construction shall be obtained from the Building
Codes Division, 723 West Markham, Little Rock,
before construction begins.
b. Before any digging or excavation begins the
responsible construction company shall contact One
Call (Pulaski County 225 -3914, Statewide
1 -800- 482 - 8998).
C. Early in the project, the 12 inch water main in
Battery Street should be uncovered so that it can
be avoided or relocated during the construction
process. If there is any damage done to water
facilities, the Hospital or contractors will please
notify the Water Works immediately so that the
facilities can be repaired. Care will be taken to
support the 12 inch main while it is uncovered.
When excavation is done in the area of this water
main, please notify the Engineering Department at
the Water Works, so that they can inspect the
facility while it is uncovered.
d. The City of Little Rock shall in no way be
responsible to maintain the installation nor to
replace any installation damaged or destroyed by
utility or City crews in their routine maintenance

work. Also, the city shall in no way be 194
responsibility should injury be inflicted on anyone
2 as a result of the presence or the installation of
3 the tunnel for which the franchise is granted.
4 SECTION 2. This resolution shall remain in full force and
5 effect from and after its adoption and approval. The City
6 reserves the right to revoke said franchise approval.
