4 A RESOLUTION TO SUPPORT THE ARKANSAS
5 RIVER FESTIVALS CONCEPT AND
PERMITTING THE CITY MANAGER TO ENTER

INTO AN AGREEMENT WITH ARKANSAS

RIVER FESTIVALS, INC.; AND FOR

OTHER PURPOSES.

WHEREAS, an organization known as Arkansas River Festivals,
11
Inc., has undertaken a study of the feasibility of festivals to
12
be held in the Julius C. Breckling Riverfront Park; and
13
WHEREAS, this organization has decided that a successful
14
festival could be held in August, 1993, and possibly attract as
15
16 many as 60,000 persons; and
WHEREAS, a commitment from the City of Little Rock to
17
support this festival is crucial to assuring individual and
18
corporate sponsorship necessary to underwrite the festival; and
19
WHEREAS, Article 12, § 5, of the Arkansas Constitution
20
forbids the City from entering into any partnership agreement,
21 particularly one that can impose liability upon the City, but
22 would permit the City to note its support for the project; and
23 WHEREAS, the City can note its support for Arkansas ,River
24 Festivals, Inc., by undertaking certain services in exchange for
25 a park rental fee during the course of the concert.
26 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
27 THE CITY OF LITTLE ROCK, ARKANSAS:
28 SECTION 1. The City Manager is authorized to enter into a
29 contractual agreement with Arkansas River Festivals, Inc.,
30 concerning services to be provided by the City in exchange for a
31 reasonable park rental for a festival to be held sometime during
32 July or August, 1993, provided that this agreement has been
33 reviewed and approved by the City Attorney.
34 SECTION 2. The City Manager is limited to providing
35 Services in exchange for park rental and in no way can sign or
36

execute any document that will subject the City to any liability
stemming from any river festival.
