HomeMy WebLinkAbout8862M M M RESOLUTION NO. _ 8,862 64 1 2 3 A RESOLUTION OF INTENT OF THE CITY OF LITTLE 4 ROCK TO CONSTRUCT A NEW LANDFILL; TO 5 COOPERATE WITH THE PULASKI COUNTY 6 REGIONAL SOLID WASTE MANAGEMENT DISTRICT; 7 TO COMPLY WITH ACT 752 OF 1991; AND FOR OTHER 8 PURPOSES. 9 10 11 WHEREAS, Federal Law mandates that municipal solid waste landfills that accept 12 any waste after October 9, 1993 are subject to extensive and expensive new technical 13 modifications and long -term monitoring requirements pursuant to the Resource 14 Conservation and Recovery Act and regulations promulgated thereunder (40 C.F.R. part 15 258 (1991)); and 16 17 WHEREAS, the City of Little Rock's existing municipal landfill has an estimated 18 remaining capacity to accommodate the City's solid waste disposal needs only until 1994, 19 and thus, to comply with new federal regulations is cost - probibitive and would not be 20 in the best interest of the City; and 21 22 WHEREAS, in order to comply with the new federal regulations, the City of Little 23 Rock has been working on the design, construction, and implementation of a new 24 landfill since 1989; and 25 26 WHEREAS, the City of Little Rock has taken the following steps to ensure that 27 the new landfill is operational prior to October 9, 1993, as required by federal 28 regulations: 29 (1) the City engaged a team of specialists to site and design the new landfill, 30 consisting of: The Mehlburger Firm, Project Manager and General Civil 31 32 Engineers; R. W. Beck & Associates, Solid Waste Planning and Facility Design; 33 and WoodWard -Clyde Consultants, Geotechnical Engineering and Geology; 34 (2) the City received and approved the site selection study prepared by the 35 specialists; 36 • • s5 1 (3) the City has acquired options to purchase the selected site; 2 (4) the City's specialists have conducted site tests, including soil borings and 3 4 analysis, and have tailored the landfill design to the geology of the site; 5 (5) the City and its specialists have assisted the Arkansas Department of 6 Pollution Control and Ecology in a preliminary site survey, and the City has 7 received a preliminary evaluation that the site is suitable; 8 (6) the City applied for and received a Certificate of Need from the Pulaski 9 County Regional Solid Waste Management Board as required by statute; 10 11 (7) the City has filed a closure plan for its existing landfill with the Arkansas 12 Department of Pollution Control & Ecology; and 13 (8) the City applied for a landfill permit from the Arkansas Department of 14 Pollution Control & Ecology; and 15 16 WHEREAS, by Act 752 of 1991 (Arkansas Code Annotated §§ 8 -6 -801 et seq.), 17 the Arkansas Legislature mandated that Regional Solid Waste Management Districts, 18 governed by Regional Solid Waste Management Boards, be created to assume the 19 primary responsibility for solid waste management within the district, to ensure the most 20 efficient and environmentally responsible management of the State's solid waste; and 21 22 WHEREAS, pursuant to Act 752 of 1991, the Arkansas Department of Pollution 23 Control & Ecology approved the creation of the Pulaski County Regional Waste 24 Management District ( "District ") which includes all of Pulaski County and the 25 municipalities located therein; 26 27 WHEREAS, pursuant to Arkansas Code Annotated § 8 -6 -711, the District has the 28 authority to assume control of new or existing solid waste landfills within Pulaski 29 County; and 30 31 WHEREAS, because the City of Little Rock has appropriated over $1,200,000 and 32 has since March, 1990 spent money and other resources of the City to develop a new 33 landfill in order that the present landfill not be subject to expensive post - closure costs; 34 35 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 36 THE CITY OF LITTLE ROCK, ARKANSAS: M r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 M M M 0 SECTION 1. That the City of Little Rock complete construction of the new municipal landfill located on the west side of Highway 367, near the City's existing landfill; SECTION 2. That the City of Little Rock complete construction of the new municipal landfill to ensure a cost - effective disposal site for the City's solid waste; to avoid unnecessary costs which would result if the City was forced to use a private landfill after closure of the existing landfill; to avoid unnecessary costs and delays which would result if the permitting process was repeated; and to help achieve the goals of the regional solid waste management plan; SECTION 3. That after the new municipal landfill is completed and operational, the City wishes to cooperate with the Pulaski County Regional Solid Waste Management District if the District elects to acquire ownership of the landfill pursuant to Arkansas Code Annotated § 8 -6 -711, including cooperating with the assumption, refunding or early redemption of any City revenue bonds issued to finance the landfill by the District, in accordance with the terms contained in the official documents governing the bond issue; SECTION 4. That if the District wishes to acquire the landfill but does not wish to operate the new landfill on its own behalf, the City of Little Rock will be allowed to bid to remain as the operator of the landfill.
