RESOLUTION NO. 8,808
A RESOLUTION AUTHORIZING THE CITY
MANAGER TO NEGOTIATE A CONTRACT TO
ACQUIRE A DRAINAGE EASEMENT FOR THE
CANDLEWOOD DRAINAGE PROJECT;
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE ALL DOCUMENTS NECESSARY FOR THE
ACQUISITION OF THE EASEMENT; AND
AUTHORIZING THE CITY ATTORNEY TO PROCEED
WITH CONDEMNATION OF THE EASEMENT IF THE
NEGOTIATIONS ARE UNSUCCESSFUL.
WHEREAS, the Public Works Department has installed new
drainage structures and improved the drainage ditch between Ison
Creek and Pine Mountain Drive to alleviate flooding of residences
on Pine Mountain Drive; and
WHEREAS, the Public Works Department has been unable to
obtain a drainage easement between Pine Mountain Drive and the
private drive at 14410 Cantrell Road; and
WHEREAS, this reach of the ditch is inadequate to handle
the flow during a normal rain event resulting in flooding to the
house at 5 Pine Mountain Drive; and
WHEREAS, this easement will allow completion of the project
and reduce flooding at this location.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION .1: The City Manager is authorized to negotiate a
contract to acquire a drainage easement for the Candlewood
Drainage Project.
SECTION 2: The Mayor and City Clerk are hereby authorized
to execute the necessary documents necessary for the acquisition
of the easement for this project.
SECTION 3: The City Attorney is authorized to proceed with
