A RESOLUTION OF INTENT TO BECOME A

XDMER OF THE PULASKI COUNTY REGIONAL
5
SOLID WASTE MANAGEMENT DISTRICT.

WHEREAS, Act 752 of 1991, requires that all Arkansas
Counties and first class cities participate in regional solid
8
waste management districts; and
9
WHEREAS, Act 752 of 1991, requires that the governing
10
boards of all regional solid waste management districts be
11
comprised of one representative from each first class city in
the district and one representative from each county in the
12
district; and
13
WHEREAS, Act 752 of 1991, establishes the powers, duties
14
and responsibilities of the regional solid waste management
15
districts; and,
16
WHEREAS, Act 752 of 1991 gives Arkansas counties with
over 50,000 population the ability to form single county
17
regional solid waste management districts; and,
18
WHEREAS, in October, 1991, the Arkansas Department of
19
Pollution Control and Ecology (PC &E) issued "Procedures for the
20
Creation of Regional Solid Waste Management Districts" under Act
752 of 1991, and the City has been provided a copy of said
21
procedures; and,
22
WHEREAS, the Board of Directors has heard a presentation
23
of the provisions of Act 752 of 1991 and received a written
24
proposal, which summarizes the Act and a copy of that proposal
25
is attached hereto and made a part hereof; and,
WHEREAS, the Board of Directors believes that its
26
interests will be best served by a Pulaski County Regional Solid
27
Waste Management District.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS

OF THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The Board of Directors is aware of the duties,
responsibilities, and powers conferred by Act 752 of 1991, and
31
acting in accordance with PC &E "Procedures for the Creation of
32
Regional Solid Waste Management Districts," expresses its intent
33
to become a member of the Pulaski County Regional Solid Waste
34
Management District and requests that the Arkansas Department of
35
Pollution Control and Ecology designate Pulaski County as a
r
regional solid waste management district.
