WHEREAS, the City is quite interested in dealing appropriately with questions concerning the disposal of medical wastes, hazardous wastes, and other such materials within the City, and WHEREAS, recent Arkansas Supreme Court decisions, trial court decisions concerning medical wastes facilities, and an Attorney General's opinion, have addressed these issues, and WHEREAS, the City may have responsibilities under the Solid Wastes Disposal Act with regard to EnviroCorp, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Attorney is directed to review recent decisions of the Arkansas Supreme Court, recent opinions of the Attorney General, and the pending litigation between State of Arkansas and the Department of Pollution Control & Ecology, and to intervene in litigation or file amicus briefs with the Arkansas Supreme Court if it is determined that to do so would be in the best interests of the City of Little Rock. SECTION 2. The City Attorney is directed to take all actions that are necessary to assure that EnviroCorp, Inc., complies with all necessary licensing procedures and permit procedures under Arkansas law to the extent that those procedures call for input from the City of Little Rock.
