HomeMy WebLinkAbout85501 RESOLUTION NO. 81550 2 3 4 A RESOLUTION ACCEPTING A RESOLUTION 5 FROM THE LITTLE ROCK HISTORIC 6 DISTRICT COMMISSION ENDORSING THE 7 PRESERVATION OF HISTORIC STRUCTURES, 8 ESTABLISHING A MORATORIUM ON THE 9 CITY'S DEMOLITION OF HISTORIC 10 STRUCTURES, AND FOR OTHER PURPOSES. 11 12 WHEREAS, on July 11, 1991, the Little Rock Historic 13 District Commission adopted a resolution asking for a moratorium 14 on the demolition of structures in the City's four historic 15 districts; and 16 WHEREAS, the Historic District Commission has jurisdiction 17 to grant a Certificate of Appropriateness on the demolition of 18 structures within the MacArthur Park Historic District; but 19 lacks similar authority in the other districts, and 20 WHEREAS, a tension that develops when structures within an 21 historic district need to be demolished for safety concerns, but 22 such demolition sacrifices structures necessary to the historic 23 nature of the district; and 24 ` UZEnG, the City needs to develop a standard policy and 25 procedure to overcome this tension. 26 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 27 THE CITY OF LITTLE ROCK, ARKANSAS: 28 SECTION 1. The City Board of Directors accepts the 29 resolution of the Little Rock Historic District Commission 30 attached as Exhibit A to this Resolution. 31 SECTION 2. The City declares that from this date forward 32 for a period of six months there will be a moratorium on the 33 demolition of houses by the City within the area covered by the 34 MacArthur Park Historic District, the Governor's Mansion 35 Historic District, the Marshall Square Historic District, and 36 the Hillcrest Historic District, provided, that such a R q9 A-1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 moratorium shall not preclude (a) demolitions necessary to Preserve the health, safety and welfare of the citizens of Little Rock, or (b) as ordered by a court of competent jurisdiction. SECTION 3. During the period of this moratorium it is the policy of the City of Little Rock to avoid demolitions by boarding and securing buildings that are in need of repair which would otherwise constitute a threat to public health and safety. SECTION 4. During the moratorium, the staff of the City is directed to develop policies and procedures aimed at saving endangered structures within these historic districts and to prepare proposed policies and procedures to be followed by the City. WHEREAS, the City of Little Rock's housing code enforcement actions are resulting in an increased number of condemnations; and WHEREAS, many of the condemned houses are contributing structures in designated historic districts; and WHEREAS, condemned houses are more often demolished than rehabilitated because of a lack of effective programs designed to encourage rehabilitation efforts; and WHEREAS, the Little Rock Historic District Commission is concerned about the impending loss to the City of historic structures; NOW, THEREFORE, BE IT RESOLVED BY THE LITTLE ROCK HISTORIC DISTRICT COMMISSION: SECTION 1. The Little Rock Board of Directors is hereby requested to immediately impose a six month moratorium on the issuance of demolition permits in all of the City's designated historic districts. The Board is also requested to direct the city staff to develop, prior to the expiration date of the moratorium, policies and procedures aimed at saving endangered historic structures. SECTION 3. The areas of the City affected by this moratorium shall be the MacArthur Park Historic District, Governor's Mansion Historic District, Marshall Square Historic District, and Hillcrest Historic District.
