Home My WebLink About22830 1 ORDINANCE NO. 22,830 2 3 AN ORDINANCE TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A SOLE-SOURCE CONTRACT WITH LITTLE ROCK REPAIR 5 SHOP FOR PHASE TWO RESTORATION SERVICES OF THE HISTORIC 6 "OVER THE JUMPS" CAROUSEL AT THE LITTLE ROCK ZOO; TO 7 PROVIDE FORA COMPETITIVE BIDDING EXEMPTION;TO PROVIDE 8 FOR THE PAYMENT OF FUNDS; TO DECLARE AN EMERGENCY;AND 9 FOR OTHER PURPOSES. 10 11 WHEREAS,the City of Little Rock,Arkansas(the"City"),owns and operates the Little Rock 12 Zoo,which includes the historic"Over the Jumps"Carousel (the"Carousel"); and, 13 WHEREAS,the Carousel is a significant historic attraction at the Little Rock Zoo and requires 14 specialized restoration services to preserve its structural integrity, historic character, mechanical 15 components, and continued operation; and, 16 WHEREAS, Little Rock Repair Shop previously completed Phase One restoration services 17 for the Carousel and, through that work, has acquired specialized knowledge and familiarity with the 18 Carousel's existing condition, components, restoration history,and remaining restoration needs; and, 19 WHEREAS, because Little Rock Repair Shop completed Phase One of the Carousel 20 restoration and possesses specialized knowledge and familiarity with the Carousel resulting from that 21 work, utilizing another contractor for Phase Two would require the duplication of research,evaluation, 22 and restoration efforts and could result in increased costs, delays, inconsistencies in restoration 23 methods,or risks to the historic integrity of the Carousel; and, 24 WHEREAS, pursuant to the authority granted under applicable Arkansas law and the City's 25 procurement requirements,the Board of Directors finds that the services to be provided by Little Rock 26 Repair Shop qualify for an exemption from competitive bidding because Little Rock Repair Shop is 27 the entity best qualified and uniquely suited to provide the continued specialized restoration services 28 based upon its prior work, experience, knowledge, and skills concerning the Carousel; and, 29 WHEREAS,the City desires to enter into a sole-source contract with Little Rock Repair Shop 30 for Phase Two restoration services for the Carousel in an amount not to exceed One Hundred Fifty 31 Thousand and 00/100 Dollars($150,000.00), including applicable taxes and fees. [Page 1 of 3] 1 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 2 CITY OF LITTLE ROCK,ARKANSAS: 3 Section 1. The City Manager is hereby authorized to enter into a sole-source contract with 4 Little Rock Repair Shop for Phase Two restoration services for the Little Rock Zoo's historic "Over 5 the Jumps" Carousel, in an amount not to exceed One Hundred Fifty Thousand and 00/100 Dollars 6 ($150,000.00), including all applicable taxes and fees. 7 Section 2. The Board of Directors hereby determines that the contract authorized by this 8 Ordinance is exempt from the City's competitive bidding requirements because Little Rock Repair 9 Shop completed Phase One of the Carousel restoration and has demonstrated the specialized 10 experience, knowledge, expertise, and skills necessary to provide the continued restoration services 11 required for Phase Two. The Board further determines that Little Rock Repair Shop is uniquely 12 qualified to continue the restoration work based upon its prior experience with the Carousel and its 13 familiarity with the restoration work already performed and it would be impracticable and unfeasible 14 to submit the selection for competitive bidding. 15 Section 3. The City Manager is authorized to execute such contract, amendments, purchase 16 orders,and other documents as may be necessary to carry out the purposes of this Ordinance,provided 17 that any amendment increasing the total contract amount beyond the amount authorized herein shall 18 require further approval as required by law. 19 Section 4.Funds for the contract authorized herein shall be paid from available appropriations 20 in Little Rock Zoo Accounts G65DS261 "AHHP Carousel 2026," S65G261 "Zoo Carousel Grant 21 Match," S71 B455 "Carousel Maintenance," and any future grant awards designated or appropriated 22 for the Carousel restoration project, subject to the availability of funds and applicable grant 23 requirements. 24 Section 3.Severability. In the event any title,section,paragraph, item,sentence,clause,phrase,or 25 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 26 adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and 27 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 28 ordinance. 29 Section 4. Repealer.
